NOTICE IS HEREBY GIVEN pursuant to Final Judgment of Foreclosure dated the 26 day of July, 2012, and entered in Case No. 11-CA-52327, of the Circuit Court of the 20TH Judicial Circuit in and for Lee County, Florida, wherein ONEWEST BANK, FSB is the Plaintiff and UNKNOWN HEIRS AND/OR BENEFICIARIES OF THE ESTATE OF KENNETH L. SMILEY, SECRETARY HOUSING & URBAN DEVELOPMENT, UNKNOWN CREDITORS OF THE ESTATE OF KENNETH LYNN SMILEY, UNKNOWN TENANT and ARLETTE WAGONER IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.Lee.realforeclose.com at, 9:00 AM on the 27 day of August, 2012, the following described property as set forth in said Final Judgment, to wit:
A TRACT OR PARCEL OF LAND LYING IN LOTS 1 AND 2, BLOCK 2, TERRY TICE AND VANDERWALKER AS RECORDED IN PLAT BOOK 1 AT PAGE 46 OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA AND BEING DESCRIBED AS FOLLOWS;
COMMENCING AT THE SOUTHEAST CORNER OF SAID LOT 1, BLOCK 2, THENCE RUN NORTHERLY ALONG THE EAST LINE OF SAID LOT 1, BLOCK 2 FOR 81 FEET TO THE POINT OF BEGINNING, THENCE FORM SAID POINT OF BEGINNING RUN WESTERLY PARALLEL TO AND 81 FEET NORTH OF THE SOUTH LINE OF LOTS 1 AND 2 SAID BLOCK 2 FOR 335.1 FEET; THENCE RUN NORTHERLY PARALLEL TO THE EAST LINE OF SAID LOT 1, BLOCK 2 FOR 130 FEET; THENCE EASTERLY PARALLEL TO THE SOUTH LINE OF SAID LOTS 1 AND 2, BLOCK 2 FOR 335.1 FEET TO THE EAST LINE OF LOT 1 BLOCK 2; THENCE RUN SOUTHERLY ALONG SAID EAST LINE FOR 130 FEET TO THE POINT OF BEGINNING.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
