NOTICE IS HEREBY GIVEN pursuant to an Order Resetting Foreclosure Sale dated the 9th day of July, 2012, and entered in Case No. 2010 CA 000271 NC, of the Circuit Court of the 12TH Judicial Circuit in and for Sarasota County, Florida, wherein THE BANK OF NEW YORK MELLON, FKA THE BANK OF NEW YORK AS SUCCESSOR IN INTEREST TO JP MORGAN CHASE BANK NA AS TRUSTEE FOR STRUCTURED ASSET MORTGAGE INVESTMENTS II INC. BEAR STEARNS ALT-A TRUST 2005-10, MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2005-10 is the Plaintiff and MARION JOHN ZACHODNY III; MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INCORPORATED AS NOMINEE FOR UNION FEDERAL BANK OF INDIANAPOLIS; TRUST AMERICA HOMES, INC., A FLORIDA CORPORATION, A DISSOLVED CORPORATION DBA FIRST AMERICAN HOMES; KRISTIN ZACHODNY; UNKNOWN TENANT N/K/A LINDA FRANK; UNKNOWN TENANT (S); IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.sarasota.realforeclose.com at, 9:00 AM on the 13th day of August, 2012, the following described property as set forth in said Final Judgment, to wit:

ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
