RUSSELLS MUSCLE CARS LLC, a Florida Limited Liability Company, and SOUTHEAST SPREADING COMPANY, LLC, a foreign Limited Liability Company,
Defendants.
Notice is given pursuant to a Final Judgment in Foreclosure filed July 31, 2012, in Case No. 12-CA-050966, of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida, in which KURT H. HARTMANN, AS SUCCESSOR TRUSTEE OF THE HARTMANN TRUST dated July 25, 1995 is the Plaintiff and RUSSELLS MUSCLE CARS LLC, a Florida Limited Liability Company, and SOUTHEAST SPREADING COMPANY, LLC, a foreign Limited Liability Company, are the Defendants, I will sell to the highest bidder for cash beginning 9:00 A.M. at www.lee.realforeclose.com in accordance with Chapter 45, Florida Statutes, on August 30, 2012, the following described property set forth in the Final Judgment in Foreclosure:
A tract or parcel lying and being in Section 11, Township 45 South, Range 24 East described as follows: From the Southwest corner of the N 1/2 of the SE 1/4 of the NE 1/4 of Section 11, Township 45 South, Range 24 East, run North 89° 17' 10” East along fractional line for a distance of 292.5 feet; thence run North 0° 22' 20” East parallel to the West line of the SE 1/4 of the NE 1/4 of said Section 11 for a distance of 333.39 feet more or less to the North line of the S 1/2 of the N 1/2 of the SE 1/4 of the NE 1/4 of said Section 11, thence run South 89° 16' 00” West along fraction line for a distance of 80 feet to the Point of Beginning of the parcel herein described; From said Point of Beginning continue South 89° 16' 00” West for a distance of 84 feet; thence run South 0° 22' 20” West for a distance of 166.67 feet more or less to the centerline of a 25 foot road easement; thence run North 89° 16' 35” East along the centerline of said 25 foot road easement for a distance of 84 feet; thence run North 0° 22' 20” East for a distance of 166.68 feet more or less to the Point of Beginning.
Together with the 3 easements as follows, to-wit:
“Tohari Road Easement: - Beginning at the Southwest corner of the N 1/2 of the SE 1/4 of the NE 1/4 of Section 11, Township 45 South, Range 24 East and run North 89° 17' 10” East along the South line of said N 1/2 of the SE 1/4 of N/E 1/4 of Section 11, Township 45 South, Range 24 East 28.5 feet to the East right of way of an Iona Drainage District right of way; thence run North 0° 22' 20” East along said right of way line, parallel to the West line of the SE ¼ of the NE ¼ of Section 11, Township 45 South, Range 24 East, 154.14 feet to the Point of Beginning of a 25 feet road easement, being 12.5 feet on each side of the following described centerline; from said Point of Beginning run North 89° 16' 35” East 264.0 feet to termination.
“Cleaves Road Easement #1” - the West 25 feet of the West 167 feet of the Easterly 600 feet of the N 1/2 of the S 1/2 of the N 1/2 of the SE 1/4 of the NE 1/4 of Section 11, Township 45 South, Range 24 East; Also the South 12.5 feet of the N 1/2 of the S 1/2 of the N 1/2 of the SE 1/4 of the NE 1/4 of Section 11, Township 45 South, Range 24 East, less the East 575 feet, and less the West 292.5 feet. Also the N 12.5 feet of the South 1/2 of the S 1/2 of the N 1/2 of the SE 1/4 of the NE 1/4 of Section 11, Township 45 South, Range 24 East, less the E 575 feet and less the W 292.5 feet thereof. Said easement subject to easement on record, Lee County, Florida.
“Cleaves Road Easement #2 - An easement over and across the Northerly 25.7 feet and over and across the Westerly 25 feet of the Westerly 167.00 feet of the Easterly 600.00 feet of the N 1/2 of the N 1/2 of the SE 1/4 of the NE 1/4 of Section 11, Township 45 South, Range 24 East.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens filed herein, must file a claim within 60 days after the sale.
