NOTICE IS HEREBY GIVEN pursuant to a Final Summary Judgment of Foreclosure dated September 04, 2009 and an Order Rescheduling Foreclosure Sale filed August 1, 2012, entered in Civil Case No.: 09-CA-58897 (H) of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida, wherein U.S. BANK NATIONAL ASSOCIATION, AS SUCCESSOR TRUSTEE TO BANK OF AMERICA, NATIONAL ASSOCIATION, AS SUCCESSOR BY MERGER TO LASALLE BANK, N.A. AS TRUSTEE FOR THE MLMI TRUST SERIES 2006-HE3, Plaintiff, and LISA A. BEAGLE, ALLEN W. BEAGLE and UNKNOWN TENANT(S) IN POSSESSION #1 n/k/a J. BEAGLE, are Defendants.
I will sell to the highest bidder for cash, on the Public Auction website of Lee County, www.lee.realforeclose.com, at 09:00 AM, on the 31 day of August, 2012, the following described real property as set forth in said Final Summary Judgment, to wit:
LOTS 29 AND 30, BLOCK 5932, UNIT 93, CAPE CORAL SUBDIVISION, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 25, PAGES 1 THROUGH 21, INCLUSIVE, of the public records of lee county, FLORIDA.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
