NOTICE IS HEREBY GIVEN pursuant to an Order Granting Plaintiff's Motion to Cancel And Reschedule Foreclosure Sale filed July 26, 2012, and entered in Case No. 09-CA-068363 of the Circuit Court of the TWENTIETH Judicial Circuit in and for BANK OF AMERICA, N.A., S/B/M TO BAC HOME LOANS SERVICING L.P., F/K/A COUNTRYWIDE HOME LOANS SERVICING, L.P., is Plaintiff, and ARTURO HERNDANDEZ, et al are Defendants, the clerk will sell to the highest and best bidder for cash, beginning at 9:00 am at www.lee.realforeclose.com, in accordance with Chapter 45, Florida Statutes, on the 12th day of October, 2012, the following described property as set forth in said Summary Final Judgment, to wit:
LOT, BLOCK E, AMENDED PLAT OF COUNTY MANOR SUBDIVISION, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 10, PAGE 2, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
LESS AND EXCEPT THE FOLLOWING:A strip of land for additional road right-of-way (ROW) purposes lying in Lot 7, Block E, Amended Plat of Country Manor, Plat Book 10 at Page 2, Lee County Records in the Northwest Quarter (NW 1/4) of Section 17, Township 44 South, Range 25 East, City of Fort Myers, Lee County, Florida, which strip is described as follows: From the Southwest corner of said Northwest Quarter of Section 17, run N 88 degrees 08 minutes 26 seconds E along the South line for 225.14 feet; thence run N 01 degree 51 minutes 34 seconds W for 25.00 feet to the North line of Michigan Avenue and the Southwest corner of said Lot 7, Block E and the Point of Beginning of the herein described strip. From said Point of Beginning continue N 01 degree 51 minutes 34 seconds W along the West line of said Lot 7 for 4.74 feet; thence N 88 degrees 10 minutes 23 seconds E for 114.69 feet to the curved Southeasterly line of said Lot 7; thence run Southwesterly along the arc of a curve to the right of radius 25.00 feet (delta 35 degrees 35 minutes 38 seconds)(chord 15.28 feet)(chord bearing S 70 degrees 20 minutes 42 seconds W) for 15.53 feet to a point of tangency; thence run S 88 degrees 08 minutes 26 seconds W along the South line of said Lot 7 for 110.14 feet to the Point of Beginning.
Any person claiming an interest in the surplus funds from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
