NOTICE IS HEREBY GIVEN that pursuant to the Final Judgment of Foreclosure entered in the above-styled cause in the Circuit Court in and for Lee County, Florida, I will sell at public auction to the highest bidder in cash, online at www.lee.realforeclose.com, at 9:00 a.m. on August 31, 2012, that certain real property situated in the County of Lee, State of Florida, more particularly described in Exhibit “A” attached hereto.

Lots 3, 4, 5, 6, 9, 10, 11 and 12, Block 2, of that certain Subdivision known as Terry, Tice and Vandawalker, according to the map or plat thereof on file and recorded in Plat Book 1, Page 46, Public Records of Lee County, Florida. LESS that certain part of Lots 9 and 10 as conveyed in O.R Book 1799, Page 2623, Public Records of Lee County, Florida and recorded on August 20, 1985, ALSO LESS AND EXCEPT, the Seaboard All Florida Railway Right-of-Way as conveyed in O.R Book 2180, Page 1832, Public Records of Lee County, Florida and recorded on October 10, 1990.

A tract or parcel of land lying in the Northeast Quarter of Section 2, Township 44 South, Range 25 East, Lee County, Florida, described as follows:
Commencing at the Southeast corner of the Northeast Quarter of the aforesaid Section 2; thence run North along the East line of said Section 2 for 411.57 feet to a point on the Northerly right-of-way line of Orange River Boulevard; thence run N.80Ëš25'31”W. along the Northerly right-of-way line for 1217.62 feet to the point of beginning; thence continue N.80Ëš25'31”W. along said Northerly right-of-way line for 101.37 feet; thence run N.00Ëš34'18”W. for 1109.78 feet; thence run East for 655.94 feet; thence run S.00Ëš17'15”E. for 864.31 feet; thence run N.80Ëš25'31”W. for 441.56 feet; thence run S.89Ëš29'07”W. for 113.84 feet; thence run South for 334.72 feet to the point of beginning.
Said tract contains 13.004 acres, more or less and is subject to easements, restrictions and reservations of record.
Bearings are based on the East line of the aforesaid Section 2 as being North.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within 60 days after the sale.
