NOTICE IS HEREBY GIVEN pursuant to a Final Summary Judgment dated July 26, 2012, entered in Civil Case No.: 10-CA-017458, DIVISION: H, of the Circuit Court of the THIRTEENTH Judicial Circuit in and for HILLSBOROUGH County, Florida, wherein THE BANK OF NEW YORK MELLON TRUST CO, N.A, AS TRUSTEE FOR THE REGISTERED HOLDERS OF ACE SECURITIES CORP. HOME EQUITY LOAN TRUST, SERIES 2004-HS1, ASSET BACKED PASS-THROUGH CERTIFICATES, is Plaintiff and KIM BRINEGAR; UNKNOWN SPOUSE OF KIM BRINEGAR; FREDRICK R. PARKHURST; UNKNOWN TENANT #1 AS TO UNIT #7812 A; UNKNOWN TENANT #2 AS TO UNIT #7812 B; UNKNOWN TENANT #1 AS TO UNIT #7814 A; UNKNOWN TENANT #2 AS TO UNIT #7814 B; ALL OTHER UNKNOWN PARTIES CLAIMING INTERESTS BY, THROUGH, UNDER, AND AGAINST A NAMED DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAME UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS, are Defendant(s).
PAT FRANK, the Clerk of Court, shall sell to the highest bidder for cash at 10:00 AM on the 2nd Floor of the George Edgecomb Building, Room 201/202, located at 800 East Twiggs Street, in Tampa, Florida, 33602, on the 13th day of September, 2012 the following described real property as set forth in said Final Summary Judgment, to wit:
LOTS 66 AND 67, OF FERN CLIFF, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 11, AT PAGE 21, OF THE PUBLIC RECORDS OF HILLSBOROUGH COUNTY, FLORIDA.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
