NOTICE IS HEREBY GIVEN pursuant to an Order Resetting Foreclosure Sale Date dated the 16th day of May, 2012, and entered in Case No. 52-2011-CA-009120, of the Circuit Court of the 6TH Judicial Circuit in and for Pinellas County, Florida, wherein DEUTSCHE BANK NATIONAL TRUST COMPANY, AS TRUSTEE FOR THE BENEFIT OF THE HARBORVIEW 2004-8 TRUST FUND is the Plaintiff and EDWARD BEHR A/K/A EDWARD C. BEHR; FOX CHASE WEST CONDOMINIUM NO. 1 ASSOCIATION, INC; FOX CHASE WEST PROPERTY OWNERS ASSOCIATION, INC; UNKNOWN TENANT N/K/A ALEX DELGADO; UNKNOWN TENANT (S) IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash, on the 20th day of September, 2012, at 10:00 AM on Pinellas County's Public Auction website: www.pinellas.realforeclose.com in accordance with chapter 45, the following described property as set forth in said Final Judgment, to wit:
THAT CERTAIN CONDOMINIUM PARCEL CONSISTING OF UNIT 262, TOGETHER WITH AN UNDIVIDED SHARE IN THE COMMON ELEMENTS APPURTENANT THERETO, IN ACCORDANCE WITH AND SUBJECT TO THE TERMS, CONDITIONS, COVENANTS, EASEMENTS, RESTRICTIONS, AND OTHER PROVISIONS OF THAT CERTAIN DECLARATION OF CONDOMINIUM OF FOX CHASE WEST CONDOMINIUM NO.1, A CONDOMINIUM, RECORDED IN O.R. BOOK 5223, PAGE 1123, AS AMENDED IN O.R. BOOK 5244, PAGE 2050, AND ACCORDING TO THE PLAT THEREOF, AS RECORDED IN CONDOMINIUM PLAT BOOK 52, PAGES 88 AND 89. PUBLIC RECORDS OF PINELLAS COUNTY, FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
