Notice is hereby given pursuant to a Final Summary Judgment of Foreclosure dated May 10, 2012 and an Order Rescheduling Foreclosure Sale dated August 21, 2012, entered in Civil Case No.: 12-CA-314 of the Circuit Court of the Twentieth Judicial Circuit in and for Collier County, Florida, wherein FLORIDA COMMUNITY BANK, NATIONAL ASSOCIATION F/K/A PREMIER AMERICAN BANK NATIONAL ASSOCIATION, SUCCESSOR BY MERGER TO FLORIDA COMMUNITY BANK, Plaintiff, and ROBERTO TREVINO, UNITED STATES OF AMERICA, are Defendants.
I will sell to the highest bidder for cash, in the atrium on the first floor of the Collier County Courthouse Annex, 3315 Tamiami Trail East, Naples, FL 34112, at 11:00 AM, on the 18 day of September, 2012, the following described real property as set forth in said Final Summary Judgment, to wit:

A TRACT OR PARCEL OF LAND LYING IN SECTION 9, TOWNSHIP 47 SOUTH, RANGE 29 EAST, COLLIER COUNTY, FLORIDA, MORE PARTICULARLY DESCRIBED AS FOLLOWS:
THE SOUTH 132.90 FEET OF THE WEST HALF (W 1/2) OF THE NORTHWEST ONE-QUARTER (W 1/4) OF THE SOUTHWEST ONE-QUARTER (SW 1/4) OF THE NORTHEAST ONE-QUARTER (NE 1/4) OF THE NORTHEAST ONE-QUARTER (NE 1/4) OF SECTION 9, TOWNSHIP 47 SOUTH, RANGE 29 EAST, COLLIER COUNTY, FLORIDA, LESS THE WESTERLY 30 FEET FOR ROAD RIGHT-OF-WAY.
LESS AND EXCEPT:
COMMENCING AT THE SOUTHEAST CORNER OF THE SOUTH 132.90 FEET OF THE WEST HALF (W 1/2) OF THE NORTHWEST ONE-QUARTER (NW 1/4) OF THE SOUTHWEST ONE-QUARTER (SW 1/4) OF THE NORTHEAST ONE-QUARTER (NE 1/4) OF THE NORTHEAST ONE-QUARTER (NE 1/4) SECTION 9, TOWNSHIP 47 SOUTH, RANGE 29 EAST, COLLIER COUNTY, FLORIDA, THENCE NORTHERLY ALONG THE EAST LINE OF SAID FRACTION OF A SECTION FOR 116.17 FEET TO THE PROLONGATION OF AN EXISTING CHAIN LINK FENCE AND THE POINT OF BEGINNING OF THE LANDS HEREIN DESCRIBED. THENCE CONTINUE NORTHERLY ALONG SAID EAST LINE OF SAID FRACTION OF A SECTION FOR 16.71 FEET; THENCE WESTERLY ALONG THE NORTHERLY LINE OF SAID FRACTION OF A SECTION FOR 137.20 FEET TO THE EASTERLY RIGHT-OF-WAY OF SOUTH 5TH STREET (60 FEET WIDE); THENCE SOUTHERLY ALONG SAID EASTERLY RIGHT-OF- WAY FOR 18.82 FEET, TO THE PROLONGATION OF AN EXISTING CHAIN LINK FENCE; THENCE, LEAVING SAID EASTERLY RIGHT-OF-WAY, EASTERLY ALONG AN EXISTING CHAIN LINK FENCE FOR 137.29 FEET TO THE EASTERLY LINE OF SAID FRACTION OF A SECTION AND THE POINT OF BEGINNING.
THIS IS NOT THE HOMESTEAD PROPERTY OF THE MORTGAGE.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
