NOTICE IS HEREBY GIVEN pursuant to a Final Summary Judgment dated AUGUST 01, 2012, entered in Civil Case No.: 2010-CA-000751 WS, of the Circuit Court of the SIXTH Judicial Circuit in and for PASCO COUNTY, Florida, wherein BANK OF AMERICA, NA SUCCESSOR BY MERGER TO BAC HOME LOANS SERVICING, LP FKA COUNTRYWIDE HOME LOANS SERVICING LP, is Plaintiff, and ALICE M. PETRUZZI A/K/A ALICE PETRUZZI; UNKNOWN SPOUSE OF ALICE M. PETRUZZI A/K/A ALICE PETRUZZI IF ANY; ANY AND ALL UNKNOWN PARTIES CLAIMING BY, THROUGH, UNDER, AND AGAINST THE HEREIN NAMED INDIVIDUAL DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE , WHETHER SAID UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES OR OTHER CLAIMANTS; PARADISE POINTE WEST COMMUNITY ASSOCIATION, INC.; POINTE WEST CONDOMINIUM ASSOCIATION, INC.; JOHN DOE AND JANE DOE AS UNKNOWN TENANTS IN POSSESSION, are Defendants.
Paula S. O'Neil, Clerk of the Court, will sell to the highest bidder for cash at 11:00 a.m. online at www.pasco.realforeclose.com on the 21st day of SEPTEMBER, 2012 the following described real property as set forth in said Final Summary Judgment, to wit:
UNIT 97 B, POINTE WEST CONDOMINIUM, A CONDOMINIUM, TOGETHER WITH AN UNDIVIDED SHARE IN THE COMMON ELEMENTS APPURTENANT THERETO, ACCORDING TO THE DECLARATION OF CONDOMINIUM AND ALL ITS ATTACHMENTS AND AMENDMENTS, AS RECORDED IN O.R. BOOK 700 PAGE 319, AND SUBSEQUENT AMENDMENTS THERETO, AND AS RECORDED IN PLAT BOOK 12, PAGES 87 90, PUBLIC RECORDS OF PASCO COUNTY, FLORIDA.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
