NOTICE IS HEREBY GIVEN pursuant to a Agreed Final Judgment and Final Judgment of Foreclosure dated November 14, 2012, setting the sale date as noticed herein, entered in the Captioned Matter of the Circuit Court of the Thirteenth Judicial Circuit in and for Hillsborough County, Florida, wherein BANK OF AMERICA, N.A., is the Plaintiff and HEAVENLY PRODUCE, INC., a Florida corporation and DAVID G. HEAVENRIDGE, an individual, are the Defendants, that the Clerk will sell to the highest and best bidder for cash at 2nd Floor of the George E. Edgecomb Building, Room 201/202, located at 800 East Twiggs Street, in Tampa, FLORIDA, in accordance with Section 45.031 of the Florida Statutes, on the 23rd day of January 2013 at 10:00 AM, or as soon as the sale may be had, the following described property:
PARCEL 1:
The North 6.00 acres of that part of the NE 1/4 of the SW 1/4 lying South of the Railroad in Section 17, Township 28 South, Range 20 East, Hillsborough County, Florida, being more particularly described as follows: Commence at the Southeast corner of the NE 1/4 of the SW 1/4 of Section 17, Township 28 South, Range 20 East, Hillsborough County, Florida; thence North 00 deg., 13 min., 10 sec., West, (assumed) along the North and South one-quarter line of said Section 17 (also being the centerline of “Tom Folsom Road”), a distance of 463.43 feet for a point of beginning. Thence West a distance of 896.40 feet; thence North 55 deg., 24 min., 20 sec., East, along the Southerly right of way boundary of the Atlantic Coastline Railroad, a distance of 1086.08 feet; thence South 00 deg., 13 min., 10 sec., East, along the North and South one-quarter line of said Section 17 and the centerline of “Tom Folsom Road”, a distance of 616.74 feet to the point of beginning; LESS AND EXCEPT the East 25 feet thereof for road right of way. A survey of a parcel of land lying in that part of the NE 1/4 of the SW 1/4 of Section 17, Township 28 South, Range 20 East, Hillsborough County, Florida, more particular described as follows: Commence at the Southeast corner of the NE 1/4 of the SW 1/4 of Section 17, Township 28 South, Range 20 East, Hillsborough County, Florida; thence North 00 deg., 13 min., 10 sec., West, (assumed) along the N & S 1/4 line of said Section 17 (also being the centerline of “Tom Folsom Road”), a distance of 463.43 feet; thence West a distance of 896.40 feet to the Southeasterly right of way line of Grantor and the point of beginning; from the point of beginning thus described, proceed thence West, a distance of 176.01 feet to the Northwesterly right of way line of Grantor, thence on said right of way line North 55 deg., 24 min., 20 sec., East, a distance of 1269.06 feet to the West right of way line of Tom Folsom Road, (50.00 feet wide as presently established); thence on said right of way line, South 00 deg., 13 min., 10 sec., East, a distance of 121.08 feet to the aforesaid South-Easterly right of way line; thence on said right of way line, South 55 deg., 24 min., 20 sec., West, a distance of 1055.80 feet to the point of beginning.
