NOTICE IS HEREBY GIVEN pursuant to an Order or Final Judgment entered in Case No. 09-CA-010959 of the Circuit Court of the THIRTEENTH Judicial Circuit in and for HILLSBOROUGH County, Florida, wherein, THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK, AS TRUSTEE FOR THE CERTIFICATEHOLDERS CWALT, INC., ALTERNATIVE LOAN TRUST 2006-OA3 MORTGAG E PASS-THROUGH CERTIFICATES, SERIES 2006-OA3, Plaintiff, and, MICHAEL J WINIAREK, et. al., are Defendants, Clerk of the Court will sell to the highest bidder for cash at www.hillsborough.realforeclose.com at the hour of 10:00 AM on the 3rd day of January 2013, the following described property:
THAT CERTAIN CONDOMINIUM PARCEL COMPOSED OF UNIT NO. 18479, BUILDING 3 OF EQUESTRIAN PARC AT HIGHWOODS PRESERVE, A CONDOMINIUM, AND AN UNDIVIDED INTEREST INTEREST OR SHARE IN THE COMMON ELEMENTS APPURTENANT THERETO, IN ACCORDANCE WITH, AND SUBJECT TO THE COVENANTS, CONDITIONS, RESTRICTIONS, EASEMENTS, TERMS AND OTHER PROVISIONS OF THE DECLARATION OF CONDOMINIUM AS RECORDED IN OFFICIAL RECORDS BOOK 15574 AT PAGE 149 THROUGH 308, AND ANY AMENDMENTS THERETO, AND THE CONDOMINIUM PLAT BOOK THEREOF, AS RECORDED IN THE PUBLIC RECORDS OF HILLSBOROUGH COUNTY, FLORIDA AND TO INCLUDE THAT CERTAIN GARAGE UNIT MORE PARTICULARLY DESCRIBED AS C-G28.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within 60 days after the sale.
