NOTICE IS HEREBY GIVEN pursuant to Final Judgment of Foreclosure dated the 7th day of December, 2012, and entered in Case No. 48-2010-CA-006474 O, of the Circuit Court of the 9TH Judicial Circuit in and for Orange County, Florida, wherein THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK AS TRUSTEE FOR THE CERTIFICATEHOLDERS CWMBS,INC. CHL MORTGAGE PASS-THROUGH TRUST 2005-HYB 4,MORTGAGE PASS-THROUGH CERTIFICATES,SERIES 2005-HYB4 is the Plaintiff and ESTENILY A. DIESTRO, CYPRESS FAIRWAY CONDOMINIUM ASSOCIATION, INC., MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., ACTING SOLELY AS A NOMINEE FOR COUNTRYWIDE HOME LOANS, INC., SARAH SERRONE and UNKNOWN TENANT(S) IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The foreclosure sale is hereby scheduled to take place on-line on the 8 day of February, 2013 at 11:00 AM at www.myorangeclerk.realforeclose.com. The Orange County Clerk of Court shall sell the property described to the highest bidder for cash after giving notice as required by section 45.031, Florida statutes, as set forth in said Final Judgment, to wit:
UNIT 6310 CYPRESS FAIRWAY CONDOMINIUM, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM RECORDED FEBRUARY 18, 2005 IN OFFICIAL RECORDS BOOK 7837, PAGES 0530 THROUGH 0616, INCLUSIVE, AND ANY AMENDMENTS THERETO, PUBLIC RECORDS OF ORANGE COUNTY, FLORIDA, TOGETHER WITH ALL APPURTENANCES THERETO AND AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS OF SAID CONDOMINIUM AS SET FORTH IN SAID DECLARATION.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within 60 days after the sale.
