NOTICE IS HEREBY GIVEN pursuant to an Order Resetting Foreclosure Sale dated the 16th day of November, 2012, and entered in Case No. 2009 CA 011891 NC, of the Circuit Court of the 12TH Judicial Circuit in and for Sarasota County, Florida, wherein CITIBANK, N.A., AS TRUSTEE FOR THE CERTIFICATEHOLDERS OF STRUCTURED ASSET MORTGAGE INVESTMENTS II TRUST 2007-AR3 MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2007-AR3 is the Plaintiff and GERALD F. FENNELL A/K/A GERALD FENNELL; UNKNOWN TENANT (S); IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.sarasota.realforeclose.com at, 9:00 AM on the 15th day of January, 2013, the following described property as set forth in said Final Judgment, to wit:

MISSION VALLEY ESTATES, Section B-1, recorded in Plat Book 13, Pages 7, 7A & 7B, of the Public Records of Sarasota County, Florida; said corner being the intersection of the Easterly right-of-way of Mackintosh Blvd. (100' wide) and the centerline of a 60' private road easement (Mustang Street); thence N 53 deg. 11'30” E along said centerline and Northerly line of said Tract 82, 334.33'; thence S 36 deg. 42'30” E, 253.08 to the Southerly line of said Tract 82; thence N 54 deg. 08'53” E, (Actual) along said Southerly line 169.00' to the Point of Beginning; thence continue N 54 deg. 08'53” E, 271.63' to the Southeasterly corner of said Tract 82; thence N 36 deg. 42'30” W, 105.93' to the Northeasterly corner of said Tract 82; thence S 89 deg. 32'30” W along the centerline of said 60' private road easement 175.54' to the P.C. of a curve concave to the Southeast and having a radius of 458.25'; thence Southwesterly along arc of said curve 146.35'; thence S 36 deg. 42'30” E, 273.29' to the P.O.B.

SAID PROPERTY IS ALSO DESCRIBED AS:

Lot 4, DIEGEL SUBDIVISION, as per plat thereof recorded in Plat Book 28, Page 40, of the Public Records of Sarasota County, Florida.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within 60 days after the sale.
