NOTICE IS HEREBY GIVEN pursuant to a Final Summary Judgment of Foreclosure filed January 27, 2012, entered in Civil Case No.: 11-CA-050959 of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida, wherein THE BANK OF NEW YORK MELLON, AS SUCCESSOR TRUSTEE UNDER NOVASTAR MORTGAGE FUNDING TRUST, SERIES 2002-3, Plaintiff, and TERRY G. LEDFORD, ROSE M. LEDFORD, are Defendants.
I will sell to the highest bidder for cash, on the Public Auction website of Lee County, www.lee.realforeclose.com, at 9:00 AM, on the 29 day of February, 2012, the following described real property as set forth in said Final Summary Judgment, to wit:
LOTS 9 AND 10, BLOCK 2559, CAPE CORAL, UNIT 37, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 17, PAGES 15 THOUGH 29, INCLUSIVE, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
