Defendants.
NOTICE IS HEREBY GIVEN that Ken Burke, CPA, as Clerk of the Circuit Court, Pinellas County, Florida will offer for sale the following described real property situated in Pinellas County, Florida described as:
Lot 1, Block 7, VIRGINIA GROVE TERRACE FOURTH ADDITION, according to the plat thereof as recorded in Plat Book 37, Page 75, of the Public Records of Pinellas County, Florida.
Together with:
All existing or subsequently erected or affixed buildings, improvements and fixtures; all easements, rights of way, and appurtenances; all water, water rights, watercourses and ditch rights (including stock in utilities with ditch or irrigation rights); and all other rights, royalties, profits relating to the real property, including without limitation all minerals, oil, gas, geothermal and similar matters, together with all present and future leases of the property and all rents from the property,
and together with all equipment, fixtures, and other articles of personal property now or hereafter owned by the grantor, and now or hereafter attached or affixed to the property, together with all accessions, parts, and additions to, all replacements of, and all substitutions for, any such property, and together with all proceeds (including without limitation all insurance proceeds and refunds of premiums) from any sale other disposition of the property.
All Furniture, Fixtures, Equipment, Machinery, Accounts Relating to Rents, Contracts, Inventory, General Intangibles, and Rental Income now owned and hereafter acquired located on the property at 2700 SR 590, Clearwater, FL 33759;
Together with:
(a) All accessions, attachments, accessories, replacements of and additions to any of the collateral described herein, whether added now or later.
(b) All products and produce of any of the property described in this Collateral section.
(c) All accounts, general intangibles, instruments, rents, monies, payments, and all other rights, arising out of a sale, lease, consignment or other disposition of any of the property described in the Collateral section.
(d) All proceeds (including insurance proceeds) from the sale, destruction, loss, or other disposition of any of the property described in this Collateral Section, and sums due from a third party who has damaged or destroyed the Collateral or from that party's insurer, whether due to judgment, settlement or other process.
(e) All records and data relating to any of the property described in this Collateral section, whether in the form of a writing, photograph, microfilm, microfiche, or electric media, together with all of Grantor's right, title, and interest in and to all computer software required to utilize, create, maintain, and process any such records or data on electronic media.
The Clerk of the Court shall sell the property to the highest bidder for cash on March 12, 2012, on Pinellas County's Public Auction website: www.pinellas.realforeclose.com at 10:00 a.m. EST in accordance with Chapter 45, Florida Statutes. The aforesaid sale will be made pursuant to a Summary Final Judgment of Foreclosure entered in Civil No. 11-006080CI-21 now pending in the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County, Florida.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
