NOTICE IS HEREBY GIVEN pursuant to an Order to Reschedule Foreclosure Sale filed January 23, 2012, and entered in Case No. 08-CA-018818 of the Circuit Court of the TWENTIETH Judicial Circuit in and for LEE COUNTY, Florida, wherein THE BANK OF NEW YORK MELLON F/K/A THE BANK OF NEW YORK AS SUCCESSOR TO JPMORGAN CHASE BANK, N.A. AS TRUSTEE OF SAMI II 2006-AR3, is Plaintiff, and ROSBEL HINOJOSA, et al are Defendants, I will sell to the highest and best bidder for cash, beginning at 9:00 am at www.lee.realforeclose.com, in accordance with Chapter 45, Florida Statutes, on the 23rd day of February, 2012, the following described property as set forth in the recorded Lis Pendens filed in the instant matter, to wit:
LOT 6,PENN DELL PARK UNIT 1, A SUBDIVISION ACCORDING TO THE PLAT OR MAP THEREOF DESCRIBED IN PLAT BOOK 29 AT PAGE 149, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
and all fixtures and personal property located therein or thereon, which are included as security in Plaintiff's mortgage.
Any person claiming an interest in the surplus funds from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
