NOTICE IS HEREBY GIVEN pursuant to an Order Granting Motion to Reschedule Sale filed January 23, 2012, and entered in 36-2010-CA-054510 of the Circuit Court of the TWENTIETH Judicial Circuit in and for Lee County, Florida, wherein BAC HOME LOANS SERVICING, LP, FKA COUNTRYWIDE HOME LOANS SERVICING, LP, is Plaintiff, and CIRIACO CHAMALE MONTENEGRO A/K/A CIRIACO C. MONTENEGRO A/K/A CIRCIACO CHAMALE MONTENEGRO; ELFER O. CHAMALE-TORRES; UNKNOWN TENANT(S) are the Defendant(s). Charlie Green as the Clerk of the Circuit Court will sell to the highest and best bidder for cash at www.lee.realforeclose.com, at 9:00 am on February 23, 2012, the following described property as set forth in said Final Judgment, to wit:
ALL THAT PARCEL OF LAND IN CITY OF FORT MYERS, LEE COUNTY, STATE OF FLORIDA, AS MORE FULLY DESCRIBED IN DEED INST # 200600248628, ID # 084425P3 048000460, BEING KNOWN AND DESIGNATED AS LOT 46, ARLINGTON, ACCORDING TO THE PLAT THEREOF, RECORDED IN PLAT BOOK 16, PAGE 38, PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
and all fixtures and personal property located therein or thereon, which are included as security in Plaintiff's mortgage.
Any person claiming an interest in the surplus funds from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
