NOTICE IS HEREBY GIVEN pursuant to an Order Resetting Foreclosure Sale dated the 23rd day of September, 2011, and entered in Case No. 09-10012, of the Circuit Court of the 20TH Judicial Circuit in and for Collier County, Florida, wherein BAC HOME LOANS SERVICING, L.P. FKA COUNTRYWIDE HOME LOANS SERVICING, L.P. is the Plaintiff and JOSEPH S. RUSK, HERITAGE BAY MASTER HOMEOWNERS ASSOCIATION, INC.; IRONSTONE BANK; QUARTZ COVE AT THE QUARRY CONDOMINIUM ASSOCIATION, INC., THE QUARRY COMMUNITY ASSOCIATION, INC., CARINA A. RUSK and UNKNOWN TENANT (S)IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash at the, atrium on the first floor of the Courthouse Annex, Collier County Courthouse, 3315 Tamiami Trail East, Naples, Florida, 34112, at 11:00 a.m. on the 24th day of January, 2012, the following described property as set forth in said Final Judgment, to wit:
CONDOMINIUM UNIT 13-202, QUARTZ COVE AT THE QUARRY, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF, AS RECORDED IN OFFICIAL RECORDS BOOK 4163, PAGE(S) 2766 THROUGH 2899, AND ANY AMENDMENTS AND/OR SUPPLEMENTAL DECLARATIONS THERETO, OF THE PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA, TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within sixty (60) days after the sale.
