NOTICE OF PUBLIC SALE
Pursuant to Florida Statute Section 713.585, Rush Truck Centers of Florida, Inc. D/B/A Rush Truck Center Orlando (“Rush”) claims a lien for labor, services, parts and/or storage on the following described vehicle(s):
1. 1994 Peterbilt 377 Truck VIN # 1XPCDB8X7RN350383; Owner/Registrant of Record: Terry Cornelius Boyce, 12309 Red Hickory Ln., Charlotte, NC 28273-3865; Lienholder of Record: Absolute Title Loans, 2026 Celanese Rd., Rock Hill, SC 29732; Customer: Titan Transport LLC / Terry Boyce, 926 Archie St., Fort Meal, SC 29715; Current amount owed to redeem the vehicle: $1,897.88 plus storage fees of $25.00 per day beginning January 18, 2012 until vehicle is retrieved or sold pursuant to lien sale.
The lien is subject to enforcement under which the vehicle can be sold to satisfy the lien claimed. Sale to be held by competitive bidding on February 15, 2012 at 10:00 a.m. at the lobby of Rush Truck Center, Orlando, 1925 W. Princeton St., Orlando, FL 32804, telephone (407) 877-3636, where the vehicle is located. Rush reserves the right to accept or reject any bid. Payment must be made by cash or certified funds only. Vehicle available for inspection prior to sale. Sale subject to cancellation without notice.
The owner of the vehicle or any person claiming an interest or lien thereon has a right to a hearing at any time prior to the scheduled date of sale by filing a demand for hearing with the clerk of the circuit court in the county in which the vehicle is being held and mailing copies of the demand for hearing to all other owners and lienors as reflected in this notice.
The owner of the vehicle has the right to recover possession of the vehicle without instituting judicial proceedings by posting bond in accordance with the provisions of Florida Statute Section 559.917.
Any proceeds from the sale of the vehicle remaining after payment of the amount claimed to be due and owing to Rush will be deposited with the clerk of the circuit court for disposition upon court order.
