This is a petition for administration of the will of Mary Elizabeth Bolton. Petitioner's son, ALAN PAUL BOLTON, files this petition and alleges:
1. Petitioner, ALAN PAUL BOLTON, has an interest in the above-estate as the natural son, the named heir, and as the named Personal Representative. ALAN PAUL BOLTON'S address is 1685 Mullet Court, Naples, Florida 34102. The name and office address of Petitioner's attorney is set forth at the end of this Petition.
2. Decedent, Mary Elizabeth Bolton, whose last known address was 1685 Mullet Court, Naples, Florida 34102 and whose age was 100 years old and the last four digits of her social security number are 4007 died on November 11, 2011, at 1685 Mullet Court, Naples, Florida 34102 and on the date of death Decedent was domiciled in Collier County, Florida.
3. So far as is known, the names of the Beneficiaries of this Estate and of the Decedent's surviving spouse, if any, their addresses and relationships to Decedent, and the dates of birth of any who are minors, are: ALAN PAUL BOLTON, 1685 Mullet Court, Naples, Florida 34102, Son. There is no surviving spouse.
4. There are three additional adult children of Mary Elizabeth Bolton who are not named in the will. Kay Rhoad; Sharon McIntosh; and Carol Morris.
5. Venue of this proceeding is in Collier County, Florida because the Decedent was a resident of Collier County, Florida.
6. ALAN PAUL BOLTON whose address is 1685 Mullet Court, Naples, Florida 34102, and who is qualified under the laws of the State of Florida to serve as Personal Representative of the Decedent's Estate is entitled to preference in appointment as the Personal Representative because he is the natural son, the sole heir, over the age of eighteen, a resident of Collier County, Florida and is named in the will as the Personal Representative.
7. The nature and approximate value of the assets in this Estate is personal property in the amount of $475,000.00.
8. This Estate will not be required to file a federal estate tax return.
9. Domiciliary or principal proceedings are not known to be pending in another state or country.
10. A copy of Decedent's death certificate is attached. Exhibit A. A copy of the will is on file and attached. Exhibit B.
11. Petitioner is unaware of any unrevoked wills or codicils of Decedent.
WHEREFORE Petitioner requests an Estate be opened and that he be appointed the Personal Representative of the estate of the Decedent, Mary Elizabeth Bolton, that no bond be required and that the will be accepted to Probate.
