NOTICE IS HEREBY GIVEN pursuant to a Final Summary Judgment of Foreclosure filed May 14, 2010 and an Order Rescheduling Foreclosure Sale filed January 18, 2012 entered in Civil Case No.: 09-CA-70598 (I) of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida, wherein CITIBANK N.A. AS TRUSTEE FOR THE MLMI TRUST SERIES 2006-HE5, Plaintiff, and MARIE E. DILKS, EGRET CONDOMINIUM ASSOCIATION, INC., UNKNOWN TENANT(S) IN POSSESSION #1 N/K/A RICHARD PRICE, are Defendants.
I will sell to the highest bidder for cash, on the Public Auction website of Lee County, www.lee.realforeclose.com, at 9:00 AM, on the 17 day of February, 2012, the following described real property as set forth in said Final Summary Judgment, to wit:
UNIT NO. 104, EGRET CONDOMINIUM, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF, AS RECORDED IN OFFICIAL RECORDS BOOK 1551, PAGES 1528 THROUGH 1582 AND AMENDMENT TO DECLARATION OF CONDOMINIUM THEREOF, AS RECORDED IN OFFICIAL RECORDS BOOK 1559, AT PAGES 1021 THROUGH 1023, ALL OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA; TOGETHER WITH ALL APPURTENANCES THEREUNTO APPERTAINING, ALL ACCORDING TO SAID DECLARATION OF CONDOMINIUM.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
