NOTICE IS HEREBY GIVEN pursuant to Final Judgment of Foreclosure dated the 9th day of January, 2012, and entered in Case No. 2010 CA 002542 NC, of the Circuit Court of the 12TH Judicial Circuit in and for Sarasota County, Florida, wherein THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK,AS SUCCESSOR TRUSTEE TO JPMORGAN CHASE BANK, N.A., AS TRUSTEE FOR THE HOLDERS OF SAMI II TRUST 2006-AR7, MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2006-AR7 is the Plaintiff and ALINA J. KIPCHUMBA; MORTGAGE ELECTRONIC REGISTRATION SYSTEMS INCORPORATED, AS A NOMINEE FOR AMERICA'S WHOLESALE LENDER; RAMBLEWOOD ACRES CONDOMINIUM ASSOCIATION, INC.; JOHN LUVAVALI; UNKNOWN TENANT (S); IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.sarasota.realforeclose.com at, 9:00 AM on the 14th day of February, 2012, the following described property as set forth in said Final Judgment, to wit:
UNIT NO. 28-C-1, RAMBLEWOOD ACRES, A CONDOMINIUM ACCORDING TO THE DECLARATION OF CONDOMINIUM RECORDED IN OFFICIAL RECORDS BOOK 1044, PAGE 1842 THROUGH 1874, AND AMENDMENTS THERETO, AND AS PER PLAT THEREOF RECORDED IN CONDOMINIUM BOOK 8, PAGE, 4, 4A THRU 4C, AS AMENDED, OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA, TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS APPURTENANT THERETO.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
