Notice is given that pursuant to a final judgment dated May 14, 2012 in Case No. 11-1117-CA of the Circuit Court of the Twentieth Judicial Circuit in and for Collier County, Florida, in which GEEZ CUZ INVESTMENTS, LLC is the Plaintiff and FRANCISCO BATISTA, XENOS GALLERIA INVESTMENT, LLC, NARA BANK, GALLERIA PLAZA CONDOMINIUM ASSOCIATION OF NAPLES, INC., and THE FOUNDATION OF PELICAN MARSH, INC. are Defendants, I will sell to the highest and best bidder for cash at the Atrium on the First Floor of the Courthouse Annex, of the Collier County Courthouse, 3315 East Tamiami Trail, Naples, Florida 34112, at 11:00 a.m. on July 16, 2012, the following-described property set forth in the order of final judgment.
Condominium Parcel: Building C, of Galleria Plaza, a Condominium, according to the Declaration of Condominium recorded in Official Records Book 2685, Page 1133 and all subsequent amendments thereto, together with an undivided share in the common elements, in the Public Records of Collier County, Florida.
Together with:
All existing or subsequently erected or affixed buildings, improvements and fixtures; all easements, rights of way, and appurtenances' all water, water rights, watercourses and ditch rights (including stock in utilities with ditch or irrigation rights); and all other rights, royalties, profits relating to the real property, including without limitation all minerals, oil, gas, geothermal and similar matters,
Together with all present and future leases of the property and all rents from the property,
And together with all equipment, fixtures, and other articles of personal property now or hereafter owned by the grantor, and no or hereafter attached or affixed to the property, together with all accessions, parts, and additions to, all replacements of, and all substitutions for, any such property, and together with all proceeds (including without limitation all insurance proceeds and refunds of premiums) from any sale other disposition of the property.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within 60 days after the sale.
