NOTICE IS HEREBY GIVEN pursuant to Final Judgment dated June 27, 2012, and entered in Case No. 2010-006460 of the Circuit Court of the Twelfth Judicial Circuit, in and for Manatee County, Florida, wherein DAVID S. BAND AND ELKCO, L.P., a Florida Limited partnership, Plaintiff; and FRED CLARK a/k/a FREDERICK N. CLARK; FRED CLARK a/k/a FREDERICK N. CLARK as Trustee for 1404 TRUST; CAK PROPERTIES, INC., a Florida corporation; DEBORAH ARBITMAN, as Trustee of the Deborah Arbitman Revocable Trust u/a/d 4/2/96; WEST COAST ELECTRICAL CONTRACTORS, INC., a Florida corporation; CLARK MOORE; GEORGE OWENS; HOWARD P. HORTON; LARRY PEARSON AIR CONDITIONING AND HEATING, INC., a Florida corporation; UNIVERSAL ENGINEERING SCIENCES, INC., a Florida corporation; LARRY CAMPBELL; DONNA M. Commence at a point 50' feet West and 25' feet South of the NE corner of Section 25, Township 35 South, Range 17 East, Manatee County, Florida, said Point of Beginning the Intersection of the South Right-Of-Way of Whitfield Avenue and the West Right-Of-Way of Old U.S. 301 (15th Street E.); Thence S. 89Ë™, 56', 00” W., Along said South Right-Of-Way line of Whitfield Avenue, A Distance of 175.00 feet for a Point Of Beginning; Thence Continue S. 89Ë™, 56' 00” W., A Distance of 147.00 feet Thence South, along the center of a 16' Foot Asphalt drive, A distance of 185.00 Feet; Thence S. 38Ë™, 22'18” E., 108.01 Feet; Thence S. 0Ë™, 04' 42” W., 35.00 Feet; Thence S. 89Ë™, 45'00” E., 80.00 Feet to an Iron pipe found; Thence North 305.20 Feet to The Point of Beginning.

Commence at a point 50' West and 25' South of the NE corner of Section 25, Township 35 South, Range 17 East, Manatee County, Florida, said point of beginning the intersection of the South right-of-way line of Whitfield Avenue and West right-of-way line of Old U.S. 301 (15th Street East); thence S. 89Ë™56'00” W. along said South right-of-way line of Whitfield Avenue, a distance of 322' for a point of beginning; thence South 185.00'; thence S. 38Ë™22'18” E., 108.01'; thence S. 0Ë™04'42” W., 35.00; thence N. 89Ë™45'00” W.; 87.00'; thence North, 43.00'; thence East, 6.00'; Thence North, 39.64', thence N. 29Ë™48'00” E., 12.18', thence North 211.00' to the aforementioned South right-of-way line of Whitfield Avenue, thence N. 89Ë™56'00” E., 8.00' to the point of beginning.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within 60 days after the sale.
