NOTICE IS HEREBY GIVEN pursuant to a Final Judgment filed June 26, 2012, entered in Case No. 11-ca-052702 of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida, wherein RICHARD W. PRINGLE, PERSONAL REPRESENTATIVE OF THE ESTATE OF MICHAEL M. STRAYHORN, is the Plaintiff and GREG W. EAGLE, INDIVIDUALLY AND AS TRUSTEE; ROTUNDA LAKES CONSERVATION ASSOCIATION, INC., 5200 RANCH LLC; RICHARD E. MCCANNA are Defendants, I will sell to the highest and best bidder for cash, beginning at 9:00 A.M. at www.lee.realforeclose.com in accordance with Chapter 45, Florida Statutes, on the 26th day of July, 2012, the property described below, as set forth in said Final Judgment:
In Lee County, Florida:
A tract of land lying in the Southeast One-Quarter of Section 30, Township 43 South, Range 24 East, City of Cape Coral, Lee County, Florida, being more particularly described as follows: Beginning at the Northeasterly corner of said Southeast One-Quarter of said Section 30, being also the Northwesterly corner of Lot 54, Block 2265, Cape Coral Unit 33, according to Plat Book 16, Pages 40 through 61, inclusive, of the Public Records of Lee County, Florida, a concrete monument, thence run South 00°19'41” East along the Easterly line of said Southeast One-Quarter of said Section 30 and the Westerly line of said Cape Coral Unit 33 for 695.00 feet to an intersection with the centerline of Sweetwater Canal (120 foot Right-of-Way); .thence run South 89°59'11” West, along the Westerly prolongation of said centerline of said Sweetwater Canal for 390.01 feet to an intersection with the Easterly Right-of-Way line of Del Prado Boulevard Extension; thence run North 00°19'00” West, along said Easterly Right-of-Way line for 702.28 feet to an intersection with the Northerly line of said Southeast One Quarter of said Section 30; thence run South 88°56'39” East, along said Northerly line for 390.11 feet to the Point of Beginning.
As to an undivided 88.64% in the property described below located in Charlotte County, Florida:
Lots 2, 3, 5, 6, 7, 8, 9, 10, 11, 12, 13, 4, 15, 16, 17, 18, 19, 20, 21, 22 and 23, Block 1, Lots 4, 5 and 8, Block 2; Lots 1, 3, 4, 5, 6 and 8, Block 3; Lots 1, 2, 3, 4, 5, 6, 7 and 8, Block: 4; and Lots 3, 4, 5 and 6, Block 5; all in ROTONDA LAKES-UNIT 2, according to the map or plat thereof as recorded in Plat Book 8, Pages 25A through 25G, Public Records of Charlotte County, Florida;
LESS AND EXCEPT: All those areas in Rotonda Lakes-Unit 2 Subdivision in plat Book 8, Pages 25A. through 25G, as follows:
Block 1: The North 25 feet of Lots 2, 3, 5 and 6; The North 100 feet of Lot 7; The West 25 feet of Lots 8 through 23; Block 4: The West 25 feet of Lots 2 and 7; and The East 25 feet of Lots 3 and 6;
As described in Quit Claim Deed recorded December 31, 1990 in Official Records Book 1136, Page 1783, Public Records of Charlotte County, Florida.
Any person claiming an interest in the surplus proceeds from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within 60 days after the sale.
