NOTICE IS HEREBY GIVEN pursuant to a Final Summary Judgment of Foreclosure filed July 6, 2012, entered in Civil Case No.: 08-CA-018195 of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida, wherein hsbc bank usa, n.a. as trustee for the holders of the deutsche alt-a securities mortgage loan trust, series 2007-oa4 mortgage pass-trough certificates, plaintiff, and richard a. swift and jane doe a/k/a kristy fitzpatrick, are Defendants.
I will sell to the highest bidder for cash, on the Public Auction website of Lee County, www.lee.realforeclose.com, at 09:00 AM, on the 6 day of August, 2012, the following described real property as set forth in said Final Summary Judgment, to wit:
LOT 3, 4 AND 5, IN BLOCK 5305, UNIT 58, OF CAPE CORAL SUBDIVISION, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 23, AT PAGE 128 THROUGH 147, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
