NOTICE IS HEREBY GIVEN pursuant to Final Judgment of Foreclosure dated the 12 day of July, 2012, and entered in Case No. 11-2009-CA-002728, of the Circuit Court of the 20TH Judicial Circuit in and for Collier County, Florida, wherein BANK OF AMERICA, N.A. is the Plaintiff and BANK OF AMERICA, N.A., THE PRESERVE AT THE SHORES AT BERKSHIRE LAKES CONDOMINIUM ASSOCIATION, INC., UNKNOWN SPOUSE OF JAIRO GUTIERREZ, UNKNOWN SPOUSE OF PILAR GUTIERREZ, JAIRO GUTIERREZ, PILAR GUTIERREZ and UNKNOWN TENANT (S) N/K/A MARTIN RENTERIA IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court will sell to the highest and best bidder for cash at the, in the atrium on the first floor of the Collier County Courthouse Annex, Collier County Courthouse, 3315 Tamiami Trail East, Naples, Florida 34112, 11:00 am on the 9 day of August, 2012, the following described property as set forth in said Final Judgment, to wit:
UNIT 602, PHASE 6, OF THE PRESERVE AT THE SHORES AT BERKSHIRE LAKES, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF, AS RECORDED IN OFFICIAL RECORDS BOOK 2594, PAGES 1409 THROUGH 1595, INCLUSIVE, AND AS SUBSEQUENTLY AMENDED, OF THE PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA. BEING THAT PARCEL OF LAND CONVEYED TO JAIRO GUTIERREZ AND PILAR GUTIERREZ FROM CHARLES J. CONRICK, IV AND MARY CELINE CONRICK, HUSBAND AND WIFE BY THAT DEED DATED 10/31/2003 AND RECORDED 11/05/2003 IN DEED BOOK 3437, AT PAGE 465 OF THE COLLIER COUNTY, FLORIDA PUBLIC REGISTRY.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within sixty (60) days after the sale.
