The Landings Racquet Club, Inc. (the “Association”), pursuant to the provisions of sections 712.05 and 712.06, Florida Statutes, certifies as follows.
1. The name of the Association desiring to preserve The Landings Racquet Club Covenants recorded originally in Official Records Book 1677, Pages 0239, et seq., of the Public Records of Sarasota County, Florida, as amended from time to time (the “Covenants”), is The Landings Racquet Club, Inc., whose post office address is 5350 Landings Blvd., Sarasota, FL 34231.
2. At the April 17, 2012, meeting of the Association's Board of Directors, not less than two-thirds (2/3rds) of the members of the Association's Board of Directors voted to preserve the Covenants.
3. Attached hereto, and incorporated herein, is an affidavit executed by a member of the Association's Board of Directors affirming that it caused the Notice containing the Statement of Marketable Title Action to be mailed or hand delivered to all members of the Association.
4. The full and complete description of all land affected by this Notice is attached hereto (“The Landings South: Parcel 1”), as described in the Covenants, and so much of the land described in the Covenants as “The Landings North” as the owners thereof shall become a member of The Landings Racquet Club, Inc., thereby subjecting their respective lands to the Covenants.
5. The Covenants, as restated and amended, with the Restated Articles of Incorporation and the Amended and Restated Bylaws of The Landings Racquet Club, Inc., attached thereto, is recorded in Official Records, Instrument # 2012018199, 38 Pages, of the Public Records of Sarasota County, Florida.
6. A copy of the Covenants is recorded with this notice as this notice is recorded in the Public Records of Sarasota County, Florida, as stamped hereon by the Clerk of the Circuit Court, Sarasota County, Florida.
