NOTICE IS HEREBY GIVEN, pursuant to the Amended (Attorney's Fees and Costs) Final Judgment in Favor of Plaintiffs and Against All Claims of Defendants/Counter-Plaintiffs dated April 19, 2012 (“Final Judgment”), and Order on Motion to Schedule Mortgage Foreclosure Sale Date dated May 14, 2012, both entered in Case No. 2009 CA 000362 NC of the Circuit Court of the Twelfth Judicial Circuit in and for Sarasota County, Florida, wherein JAMES D. HENDERSON and DAVID P. HENDERSON are Plaintiffs (“Plaintiffs”), and SELECT SELF STORAGE, LLC, a Florida limited liability company, STACHURA & STACHURA REAL ESTATE INVESTMENTS, LLC, a Florida limited liability company, WALTER J. STACHURA and DOROTHY M. PSALTIS are Defendants, (which said Final Judgment was partially assigned by Plaintiffs to Ashton Properties, LLC on May 24, 2012, pursuant to that certain Partial Assignment of Final Judgment recorded in the Public Records of Sarasota County, Florida at Official Records Instrument No. 2012067320 on May 25, 2012, whereby Plaintiffs assigned all of their right, title and interest in and to that portion of the Final Judgment foreclosing a Balloon Mortgage as set forth in Section I. A. of said Final Judgment), Karen E. Rushing, Clerk of the Circuit Court for the Twelfth Judicial Circuit in and for Sarasota County, Florida will sell to the highest and best bidder for cash via the internet at www.sarasota.realforeclose.com, at 9:00 a.m. on the 18th day of June 2012, all as provided by Chapter 45 of the Florida Statutes, the following described property as set forth in the Final Judgment, to wit:

Commence at the NE corner of the SW 1/4 of Section 11, Township 37 South, Range 18 East; thence S89º50'56”W, along the North line of said SW 1/4, 334.77 feet; thence S0º01'04”E, parallel with the West line of the East 1/2 of NE 1/4 of said SW 1/4, 40 feet to the Southerly Right of Way of Ashton Road for a Point of Beginning; thence N89º50'56”E, along said R/W line, 149.75 feet to its intersection with the lands conveyed to the School Board of Sarasota County, recorded in O.R. Book 3036, Page 2023, Public Records of Sarasota County, Florida; thence along said lands of School Board, S84º53'26”E, 95.46 feet to its intersection with aforesaid Southerly R/W line of Ashton Road; thence along said R/W line, S83º00'49”E, 50.28 feet; thence continue along said R/W line, N89º50'56”E, 2.44 feet to its intersection with aforesaid lands conveyed to the School Board of Sarasota County; thence along said lands of School Board, S44º42'21”E, 16.43 feet; thence continue along said lands of School Board, S0º01'06”W, 106.22 feet; thence continue along said lands of School Board, S3º30'11”E, 260.49 feet; thence continue along said lands of School Board, N89º58'54”E, 10.00 feet to the East line of said SW 1/4 at a point lying 433.00 feet Southerly of the NE corner of said SW 1/4; thence S0º01'06”W, along said East line of SW 1/4, 234.87 feet; thence S89º50'56”W, 334.35 feet; thence N0º01'04”W, and parallel with the aforesaid West line of East 1/2 of NE 1/4 of SW 1/4, 627.87 feet to the Point of Beginning. Less any portion lying with Ashton Road Right of Way. Lying and being in the SW 1/4 of Section 11, Township 37 South, Range 18 East, Sarasota County, Florida.
Any Person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
