NOTICE IS HEREBY GIVEN pursuant to an Order Resetting Foreclosure Sale Date dated the 24th day of May, 2012, and entered in Case No. 2008CA025475O, of the Circuit Court of the 9TH Judicial Circuit in and for Orange County, Florida, wherein THE BANK OF NEW YORK MELLON FORMERLY KNOWN AS THE BANK OF NEW YORK AS SUCCESSOR TRUSTEE TO JPMORGAN CHASE BANK, N.A. AS TRUSTEE OF STRUCTURED ASSET MORTGAGE INVESTMENTS II INC., BEAR STEARNS ALT-A TRUST, MORTGAGE PASS-THROUGH CERTIFICATES SERIES 2005-10 is the Plaintiff and JAIME PALOMINO; HORIZONS AT VISTA LAKES CONDOMINIUM ASSOCIATION, INC.; VISTA LAKES COMMUNITY ASSOCIATION, INC.; MIRIAM POLOMINO; UNKNOWN TENANT (S) A/K/A FERNANDO RANGEL; UNKNOWN TENANT(S); JOHN DOE; JANE DOE AS UNKNOWN TENANT (S) IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The foreclosure sale is hereby scheduled to take place on-line on the 12th day of July, 2012 at 11:00 AM at www.myorangeclerk.realforeclose.com. The Orange County Clerk of Court shall sell the property described to the highest bidder for cash after giving notice as required by section 45.031, Florida statutes, as set forth in said Final Judgment, to wit:
UNIT 101, PHASE 4, HORIZONS AT VISTA LAKES, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM AS RECORDED IN OFFICIAL RECORDS BOOK 7819, PAGE 4894, AS AMENDED BY FIRST AMENDMENT TO DECLARATION AS RECORDED IN OFFICIAL RECORDS BOOK 7820, PAGE 3073, AS AMENDED BY SECOND AMENDMENT TO DECLARATION AS RECORDED IN OFFICIAL RECORDS BOOK 7893, PAGE 2882, AS AMENDED BY FIFTH AMENDMENT TO DECLARATION TO CORRECT SCRIVENER'S ERROR RECORDED IN OFFICIAL RECORDS BOOK 8030, PAGE 1, AS AMENDED BY EIGHT AMENDMENT TO DECLARATION RECORDED IN OFFICIAL RECORDS BOOK 8149, PAGE 4091, AND ALL ITS ATTACHMENTS AND AMENDMENTS, TO BE RECORDED IN THE PUBLIC RECORDS OF ORANGE COUNTY, FLORIDA. TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS AND ALL APPURTENANCES HEREUNTO APPERTAINING AND SPECIFIED IN SAID DECLARATION OF CONDOMINIUM.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within 60 days after the sale.
