NOTICE IS HEREBY GIVEN that pursuant to a Uniform Final Judgment of Mortgage Foreclosure dated the 8th day of June, 2012 and entered in Civil Action Number: 2011-CA-6722 in the Circuit Court of the Twelfth Judicial Circuit, in and for Manatee County, Florida, R.B. “CHIPS” SHORE, Clerk of the above-entitled Court, will sell to the highest and best bidder, or bidders, for cash, via the Internet: www.manatee.realforeclose.com, at 11:00 a.m. on the 8th day of August, 2012 the real and personal property described as follows and as set forth in said Uniform Final Judgment of Mortgage Foreclosure situate in Manatee County, Florida:
All of Sunrise Financial Services, Inc.'s right, title and interest now owned or hereafter acquired in and to each of the following (collectively, the “Property”):
(i) all those certain tracts of land in the City of Sarasota, County of Manatee, State of Florida described as follows:
Begin at the SE corner of Section 24, Township 35 South, Range 17 East; thence South 89°68'30” West along the South line of said Section 24, also being the centerline of Whitfield Avenue, 1007.14 feet; thence North parallel to the East line of said Section 24, 25.00 feet to the intersection of said line and the North right-of-way of said Whitfield Avenue for a Point of Beginning; thence continue North and parallel to the said East line of Section 24, 200.00 feet; thence South 89°58'30” West parallel to the said South line of Section 24, 286.75 feet; thence South and parallel to the West line of the SE ¼ of the SE ¼ of said Section 24, 200.00 feet to the intersection of said line and the said North right-of-way of Whitfield Avenue; thence North 89°58'30” East along said North right-of-way parallel to said centerline of Whitfield Avenue and 25.00 feet therefrom, 286.65 feet to the Point of Beginning, being and lying in Section 24, Township 35 South, Range 17 East, Manatee County, Florida.
Less additional right-of-way conveyed in O.R. Book 414, Page 429, of the Public Records of Manatee County, Florida.
Together with a 40 foot wide easement for ingress and egress, described as follows:
Begin at the SW corner of SE ¼ of the SE ¼ of Section 24, Township 35 South, Range 17 East; thence North 00°01'42” West along the West line of said SE ¼ of SE ¼, 25.0 feet to the intersection of said line and the North right-of-way of Whitfield Avenue for a Point of Beginning; thence continue North 00°01'42” West 200.00 feet; thence North 89°58'30” East 40.0 feet; thence South 00°01'42” East, parallel to the West line of said SE ¼ of the SE ¼ and 40.0 feet therefrom, 200.00 feet to the intersection of said line and the North right-of-way of said Whitfield Avenue; thence South 89°58'30” West along said North right-of-way, 40.0 feet to the Point of Beginning. Being and lying in Section 24, Township 35 South, Range 17 East, Manatee County, Florida. Said easement lying immediately adjacent to the first described property, less the South 9 feet therefrom.
(the “Land”);
(ii) all buildings and improvements now or hereafter erected on the Land;
(iii) all fixtures attached to the Land or any buildings or improvements situated thereon; and
(iv) all estates, rights, tenements, hereditaments, privileges, rents, issues, profits, easements, and appurtenances of any kind benefitting the Land; all means of access to and from the Land, whether public or private; and all water and mineral rights.
AND
In the event Sunrise Financial Services, Inc. is the owner of a leasehold estate with respect to any portion of the Property and Sunrise Financial Services, Inc. obtains a fee estate in such portions of the Property, then, such fee estate shall automatically, and without further action of any kind on the part of Sunrise Financial Services, Inc., be and become subject to the security title and lien of this Agreement.
AND
Sunrise Financial Services, Inc. hereby grants a security interest in any personal property included in the Property.
AND
All the leases, rents, issues and profits of the Property (collectively “Rents”).
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens, must file a claim within sixty (60) days after the sale.
