NOTICE IS HEREBY GIVEN pursuant to an Order Resetting Foreclosure Sale Date dated the 4th day of June, 2012, and entered in Case No. 09-36622, of the Circuit Court of the 9TH Judicial Circuit in and for Orange County, Florida, wherein THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK AS TRUSTEE FOR THE CERTIFICATEHOLDERS OF CWALT 2005-16 is the Plaintiff and RICKY PHONG MAC; PARK NORTH AT CHENEY PLACE CONDOMINIUM ASSOCIATION, INC.; UNKNOWN TENANT (S); JOHN DOE; JANE DOE AS UNKNOWN TENANT (S) IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The foreclosure sale is hereby scheduled to take place on-line on the 20th day of July, 2012 at 11:00 a.m., to the highest bidder for cash www.myorangeclerk.realforeclose.com. The Orange County Clerk of Court shall sell the property described to the highest and best bidder for cash after giving notice as required by section 45.031, Florida statutes, as set forth in said Final Judgment, to wit:
UNIT 440, PARK NORTH CHENEY PLACE ACCORDING TO THE DECLARATION OF CONDOMINIUM RECORDED IN OR BOOK 7712, PAGE 2212, OF THE OFFICIAL RECORDS OF ORANGE COUNTY FLORIDA, AND ALL ITS ATTACHMENTS AND AMENDMENTS THERETO, ALL IN THE PUBLIC RECORDS OF ORANGE COUNTY, FLORIDA, TOGETHER WITH PARKING SPACE NUMBER 305 AS DESCRIBED IN THE DECLARATION OF CONDOMINIUM, TOGETHER WITH AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS APPURTENANT THERETO.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within 60 days after the sale.
