Notice is hereby given that pursuant to the final judgment of foreclosure entered on May 30, 2012, in Case No. 10-CA-009147 of the Circuit Court of the Thirteenth Judicial Circuit in and for Hillsborough County, Florida, in which Deutsche Bank National Trust Company (f/k/a Bankers Trust Company of California, N.A.), as Trustee on Behalf of the Owners of Mortgage Pass-Through Certificates Series 2001-AM1, is plaintiff, and Marilyn McPhail a/k/a Marilyn Leon McPhail a/k/a Marilyn T. McPhail, Bay Publications, Inc., d/k/a The Real Estate Book; Capital One Bank; Cory Lake Isles Property Owners Association, Inc.; Harris and Hunt, P.A.; United States of America Department of Treasury; James A. McPhail; Unknown Tenant(s) in possession of the subject property, are Defendants, the Clerk, Pat Frank, shall offer for sale the following described real property:
LOT 13, BLOCK 4, CORY LAKE ISLES PHASE 1, UNIT 2, ACCORDING TO THE MAP OR PLAT THEREOF AS RECORDED IN PLAT BOOK 73, PAGE 6 OF THE PUBLIC RECORDS OF HILLSBOROUGH COUNTY, FLORIDA.
The sale will be held on September 04, 2012 at 10:00 A.m., and sold to the highest and best bidder for cash, on the 2nd Floor, Rooms 201/202 in the George E. Edgecomb Courthouse at 800 E. Twiggs Street, Tampa, Florida 33602, in accordance with Section 45.031 of the Florida Statutes.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within sixty (60) days after the sale.
The United States shall not be bound by the sixty day time period imposed by § 45.032, Fla. Stat., upon motions for distribution of surplus proceeds.
