Notice is hereby given, pursuant to the Partial Summary Judgment of Foreclosure and Judgment for Damages entered in the above noted case, that the Clerk of the Court will sell the following promissory notes, mortgages and related personal property as described in EXHIBIT “A” attached to this Notice of Sale, to the highest and best bidder for cash on April 3, 2012, at 10:00 a.m. via internet at www.pinellas.realforeclose.com. The highest bidder shall immediately post with the Clerk, a deposit equal to 5% of the final bid unless the final judgment states otherwise. The deposit must be paid immediately following the sale and is a non-refundable deposit. The balance of the bid, documentary stamp tax, Clerk's fee for holding the sale and the Registry of the Court fee must be made by 4:00 p.m. on the day of the sale unless otherwise ordered by the Court. ALL MONEY PAID MUST BE IN CASH, OFFICIAL BANK CHECKS AND/OR CASHIER'S CHECK DRAWN ON A UNITED STATES BANK ONLY. CHECKS MUST BE PAYABLE TO: CLERK OF COURT. IF YOU ARE A PERSON CLAIMING A RIGHT TO FUNDS REMAINING AFTER THE SALE, YOU MUST FILE A CLAIM WITH THE CLERK NO LATER THAN 60 DAYS AFTER THE SALE. IF YOU FAIL TO FILE A CLAIM, YOU WILL NOT BE ENTITLED TO ANY REMAINING FUNDS. AFTER 60 DAYS, ONLY THE OWNER OF RECORD AS OF THE DATE OF THE LIS PENDENS MAY CLAIM THE SURPLUS.
EXHIBIT “A”
1. Promissory Note dated June 1, 2007 from Mark A. Duquesnay and Rosalind T. Duquesnay, his wife, to J.J. Danmar, Inc., a Florida corporation and Robley Investments, LC, a Florida limited liability company, in the original principal sum of $1,000,000.00; and
2. Mortgage dated May 31, 2007 as given by J.J. Danmar, Inc., a Florida corporation and Robley Investments, LC, a Florida limited liability company, to Mark A. Duquesnay and Rosalind T. Duquesnay, his wife, as recorded in Official Records Book 15828, Page 1457 of the Public Records of Pinellas County, Florida.
