NOTICE IS HEREBY GIVEN pursuant to an Order Resetting Foreclosure Sale dated the 20th day of February, 2012, and entered in Case No. 48-2010-CA-002344 O, of the Circuit Court of the 9TH Judicial Circuit in and for Orange County, Florida, wherein THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK AS TRUSTEE FOR THE CERTIFICATEHOLDERS OF CWMBS 2003-30 is the Plaintiff and SOCORRO NIETO A/K/A J. SOCORRO NIETO; REGAL POINTE HOMEOWNERS ASSOCIATION INC.; THE BANK OF NEW YORK MELLON F/K/A THE BANK OF NEW YORK TRUSTEE FOR CWHEQ REVOLVING HOME EQUITY LOAN TRUST SERIES 2007-C; WACHOVIA BANK; MARIA C. NIETO; UNKNOWN TENANT (S); JOHN DOE; JANE DOE AS UNKNOWN TENANT (S) IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The foreclosure sale is hereby scheduled to take place on-line on the 23rd day of April, 2012 at 11:00 AM at www. myorangeclerk.realforeclose.com. The Orange County Clerk of Court shall sell the property described to the highest bidder for cash after giving notice as required by section 45.031, Florida statutes, as set forth in said Final Judgment, to wit:
LOR 24, REGAL POINTE PHASE 2, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 47, PAGES 133 AND 134, OF THE PUBLIC RECORDS OF ORANGE COUNTY, FLORIDA
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within 60 days after the sale.
