NOTICE IS HEREBY GIVEN pursuant to an Order Rescheduling Foreclosure Sale Filed MARCH 13, 2012 and a Final Summary Judgment filed SEPTEMBER 30, 2010, entered in Civil Case No.: 2009CA055343, of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida, wherein FREEDOM MORTGAGE CORPORATION, is Plaintiff, and SUSANNE R. LECLAIR; UNKNOWN SPOUSE OF SUSANNE R. LECLAIR IF ANY; ANY AND ALL UNKNOWN PARTIES CLAIMING BY, THROUGH, UNDER AND AGAINST THE HEREIN NAMED INDIVIDUAL DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAID UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES OR OTHER CLAIMANTS; FOREST LAKE TOWNHOMES HOMEOWNER'S ASSOCIATION, INC.; MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC.; JOHN DOE AND JANE DOE AS UNKNOWN TENANTS IN POSSESSION, are Defendants.
CHARLIE GREEN, the Clerk of Court shall sell to the highest bidder for cash online at www.lee.realforeclose.com at 9:00 a.m., on the 13 day of April, 2012 the following described real property as set forth in said Final Summary Judgment, to wit:
UNIT 105, BUILDING 6, PHASE 12, OF FOREST LAKE TOWNHOMES, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
a parcel of land lying in section 31, t445, r25e, said parcel also being a portion of tract “c”, forest lake townhomes, according to the plat thereof, as recorded in plat book 75, at page 71, in the public records of lee county, florida, being more particularly described as follows:
commencing at the sw corner of said tract “c”, thence n. 89 deg 48' 08” e., along the s boundary of said tract “c”, THENCE N. 89 DEG 48' 08” E., ALONG THE S BOUNDARY OF SAID TRACT “C”, 563.94 FEET; thence n. 00deg 13' 05” W., 12.25 feet to the point of beginning; thence continue n. 00 deg. 13' 05” w., 58.70 feet; thence n. 89 deg 46' 55” E., 16.00 feet; THENCE S. 00 DEG 13' 05” E., 58.70 FEET; THENCE S. 89 DEG 46' 55” W., 16.00 FEET to the point of beginning.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
