FIRST INSERTION
PETITION FOR DISCHARGE
IN THE CIRCUIT COURT FOR PINELLAS COUNTY, FLORIDA
PROBATE DIVISION
Case No. 08-7537-ES-004
In re: ESTATE OF
BRIAN SKELLY,
Deceased.
Petitioner, ROBERT J. JONES, Esquire, as Personal Representative of the above estate, alleges:
1. The decedent, BRIAN SKELLY died on October 26, 2008, and Letters of Administration were issued to Petitioner's predecessor on December 10, 2008. Petitioner was appointed Successor Personal Representative on May 17, 2010.
2. A Final Accounting was filed in the estate on January 19, 2012.
3. The estate left no real or personal property exempt under the provisions of sec. 732. 402, Fla. Stats., or the Florida Constitution.
4. The assets of the estate after the decedent's creditors were paid, passed by intestacy to decedent's heirs Cherise L. Skelly and Brian R. Skelly, after decedent's wife, Sheryl E. Sanders, disclaimed her interest in the estate. Disclaimer was filed on May 4, 2009.
5. Petitioner has fully administered this estate by making payment, settlement or other disposition of any claims that were entitled to payment that were presented, and by paying or making provision for the payment of all taxes and expenses of administration.
6. Petitioner has filed all required estate tax returns with the Internal Revenue Service and with the Department of Revenue of the State of Florida, and has obtained and filed with this Court evidence of the satisfaction of this estate's obligations for both federal and Florida estate taxes, if any.
7. Petitioner has made or proposes to make distribution of the assets of this estate as set forth in the Plan of Distribution filed contemporaneously with this pleading.
8. There are no other persons other than those named above and the Petitioner who have an interest in this proceeding.
9. Petitioner requests that, after satisfactory proof has been presented that distribution has been made in accordance with the Plan of Distribution and that claims of creditors have been paid or otherwise disposed of, an Order be entered discharging Petitioner as Personal Representative of this Estate, and releasing the surety on any bond which Petitioner may have posted in this proceeding from any further liability on it.
