NOTICE IS HEREBY GIVEN pursuant to an Order Rescheduling Foreclosure Sale dated March 16, 2012 and a Final Summary Judgment dated September 13, 2010, entered in Civil Case No.: 2010-CA-3148-O, of the Circuit Court of the NINTH Judicial Circuit in and for ORANGE COUNTY, Florida, wherein BAC HOME LOANS SERVICING, LP FKA COUNTRYWIDE HOME LOANS SERVICING LP, is Plaintiff, and ANTHONY D. SMITH; UNKNOWN SPOUSE OF ANTHONY D. SMITH IF ANY; ANY AND ALL UNKNOWN PARTIES CLAIMING BY, THROUGH, UNDER, AND AGAINST THE HEREIN NAMED INDIVIDUAL DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAID UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES OR OTHER CLAIMANTS; MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. AS NOMINEE FOR RYLAND MORTGAGE COMPANY; AVALON PARK PROPERTY OWNERS ASSOCIATION, INC.; PROFESSIONAL MANAGEMENT, INC., MELANIE SMITH; STATE OF FLORIDA, DEPARTMENT OF REVENUE; JOHN DOE AND JANE DOE AS UNKNOWN TENANTS IN POSSESSION, are Defendants.
LYDIA GARDNER, the Clerk of Court shall sell to the highest bidder for cash online at www.myorangeclerk.realforeclose.com at 11:00 a.m. on the 19th day of April, 2012 the following described real property as set forth in said Final Summary Judgment, to wit:
LOT 164, OF AVALON PARK NORTHWEST VILLAGE PHASE 2, 3 AND 4, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 63, AT PAGE(S) 94 THROUGH 103, INCLUSIVE, OF THE PUBLIC RECORDS OF ORANGE COUNTY, FLORIDA.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
