NOTICE IS HEREBY GIVEN pursuant to an Order Rescheduling Foreclosure Sale dated March 14, 2012 and a Final Summary Judgment dated April 21, 2011, entered in Civil Case No.: 2010CA050552, of the Circuit Court of the Twentieth Judicial Circuit in and for Lee County, Florida, wherein AURORA LOAN SERVICES, LLC, is Plaintiff, and timothy e. marchessault a/k/a tim marchessault; robin L. marchessault a/k/a robin marchessault; ANY AND ALL UNKNOWN PARTIES CLAIMING BY, THROUGH, UNDER, AND AGAINST THE HEREIN NAMED INDIVIDUAL DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAID UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES OR OTHER CLAIMANTS; PNC BANK, NATIONAL ASSOCIATION F/K/A NATIONAL CITY BANK; JOHN DOE AND JANE DOE AS UNKNOWN TENANTS IN POSSESSION, are Defendants.
CHARLIE GREEN, the Clerk of Court shall sell to the highest bidder for cash online at www.lee.realforeclose.com at 9:00 a.m. on the 16th day of April, 2012 the following described real property as set forth in said Final Summary Judgment, to wit:
lots 40 and 41, block 77, unit 6, part 3, cape coral subdivision, according to the plat thereof as recorded in plat book 11, pages 70 to 79, inclusive, of the public records of lee county, florida.
If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
