NOTICE IS HEREBY GIVEN pursuant to an Order Resetting Foreclosure Sale filed the 25 day of April, 2012, and entered in Case No. 36-2011-CA-053022, of the Circuit Court of the 20TH Judicial Circuit in and for Lee County, Florida, wherein BANK OF AMERICA, N.A. is the Plaintiff and CARLOS H. ARBOLEDA and NEIVA M. ARBOLEDA IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.Lee.realforeclose.com at, 9:00 AM on the 2 day of July, 2012, the following described property as set forth in said Final Judgment, to wit:

From a concrete post marking the Southeast corner of Government Lot 2, Section 5, Township 45 South, Range 21 East, run South 8Ëš 40' West 415.06 feet along the East line of said Section 5, Township 45 South, Range 21East, thence North 81Ëš 20' West along the South line of Block 5, Castaway Key 830 feet to the Point of Beginning. Thence North 81Ëš 20' West 75 feet; thence North 8Ëš 40' East 125 feet; thence South 81Ëš 20' East 75 feet ; thence South 8Ëš 40' West 125 feet to the point of Beginning, being Lot 6, Block 5, of an unrecorded subdivision known as CASTAWAY KEY and lying in Government Lots 2 and 3, Section 5, Township 45 South, Range 21 East, Upper Captiva Island, Lee County, Florida. A 6 foot easement on each boundary for drainage and public utilities. Also a 25 foot easement for road right-of-way purposes on the North.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
