NOTICE IS GIVEN that, in accordance with the Final Judgment of Mortgage Foreclosure filed May 1, 2012, in the above-styled cause, I will sell following property situated in Lee County, Florida, described as:
Lot 1, Colonial Properties, Phase 1, according to the plat thereof recorded in Plat Book 51, Pages 68 through 70, Public Records of Lee County, Florida.
at public sale, to the highest and best bidder, for cash, the Clerk of the Circuit Court of Lee County, Florida, shall sell the property at public sale on May 31, 2012, at 9:00 a.m., to the highest bidder for cash, except as set forth in this Judgment, beginning 9:00 a.m. at www.lee.realforeclose.com in accordance with ยง45.031, Fla. Statutes. The highest bidder shall immediately post with the Clerk, a deposit equal to 5% of the final bid. The deposit must be cash or cashier's check payable to the Clerk of the Circuit Court. Final payment must be made by 4:00 p.m. on the next business day of the date of the sale by cash or cashier's check.
IF YOU ARE A PERSON CLAIMING A RIGHT TO FUNDS REMAINING AFTER THE SALE, YOU MUST FILE A CLAIM WITH THE CLERK NO LATER THAN 60 days after the sale. If you fail to file a claim, you will not be entitled to any remaining funds. After 60 DAYS, ONLY THE OWNER OF RECORD AS OF THE LIS PENDENS MAY CLAIM THE SURPLUS.
