NOTICE IS HEREBY GIVEN pursuant to Final Judgment of Foreclosure dated the 26th day of October, 2012, and entered in Case No. 48-2011-CA-005433-O, of the Circuit Court of the 9TH Judicial Circuit in and for Orange County, Florida, wherein CITIMORTGAGE, INC. is the Plaintiff and RICHARD H. SMITH, CLASSIC MARCITE, SOUTHPOINTE CONDOMINIUM ASSOCIATION, INC., VENTURA COUNTRY CLUB COMMUNITY HOMEOWNERS ASSOCIATION, INC., AMY R. SMITH and UNKNOWN TENANT(S) IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The foreclosure sale is hereby scheduled to take place on-line on the 4th day of January, 2013 at 11:00 AM at www.myorangeclerk.realforeclose.com. The Orange County Clerk of Court shall sell the property described to the highest bidder for cash after giving notice as required by section 45.031, Florida statutes, as set forth in said Final Judgment, to wit:
CONDOMINIUM UNIT L1 (THE UNIT), IN BUILDING 38, IN SOUTHPOINTE, UNIT III, A CONDOMINIUM ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF, AS RECORDED IN OFFICIAL RECORDS BOOK 3627, PAGE 2468, TOGETHER WITH A SURVEY AND PLOT PLAN RECORDED IN CONDOMINIUM BOOK 11, PAGES 45 AND 46, ALL IN THE PUBLIC RECORDS OF ORANGE COUNTY, FLORIDA AND FURTHER AMENDMENTS, IF ANY, TO SAID DECLARATION (SAID DECLARATION AND AMENDMENTS THERETO HEREINAFTER COLLECTIVELY REFERRED TO AS THE DECLARATION), TOGETHER WITH ALL APPURTENANCES THERETO, INCLUDING AN UNDIVIDED INTEREST IN THE COMMON ELEMENTS APPERTAINING TO THE UNIT, AS MORE PARTICULARLY SET FORTH IN THE DECLARATION.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within 60 days after the sale.
