NOTICE IS HEREBY GIVEN that sale will be made pursuant to a Final Judgment. Final Judgment was awarded on November 1, 2012 in Civil Case No: 112010CA007017, of the Circuit Court of the Twentieth Judicial Circuit in and for Collier County, Florida, wherein FLAGSTAR BANK, FSB is the Plaintiff, and, ANN DOWNS; TERRY DOWNS; NATIONAL CITY BANK; TERRACE IV AT CYPRESS TRACE ASSOCIATION, INC.; CYPRESS WOODS GOLF & COUNTRY CLUB MASTER PROPERTY OWNERS ASSOCIATION,; ANY AND ALL UNKNOWN PARTIES CLAIMING BY, THROUGH, UNDER AND AGAINST THE HEREIN NAMED INDIVIDUAL DEFENDANT(S) WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAID UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES, OR OTHER CLAIMANTS, are Defendants.

will sell to the highest bidder for cash at the courthouse located at Courthouse Annex, 1st Floor Atrium, 3315 East Tamiami Trail, Naples, FL 34112 in COLLIER County, Florida at 11:00 a.m. on the 3rd day of December, 2012, the following described property as set forth in said Final Judgment, to wit:
UNIT 2833, BUILDING 28, TERRACE IV AT CYPRESS TRACE, A CONDOMINIUM, ACCORDING TO THE DECLARATION OF CONDOMINIUM THEREOF, RECORDED IN OFFICIAL RECORDS BOOK 3672, PAGE 2169, OF THE PUBLIC RECORDS OF COLLIER COUNTY. FLORIDA.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
