NOTICE IS HEREBY GIVEN pursuant to a Final Judgment of Foreclosure dated November 5, 2012, and entered in Case No. 2012 CA 003611 NC, of the Circuit Court of the Twelfth Judicial Circuit in and for SARASOTA County, Florida. BAYVIEW LOAN SERVICING, LLC, A DELAWARE LIMITED LIABILITY COMPANY (hereafter “Plaintiff”), is Plaintiff and LILLIAN M. PENNINGTON A/K/A LILLIAN ALDERMAN PENNINGTON A/K/A LILLIAN M. ALDERMAN; JP MORGAN CHASE BANK, N.A., are defendants. I will sell to the highest and best bidder for cash via the Internet at www.sarasota.realforeclose.com, at 9:00 a.m., on the _8th_ day of _January_, 2013, the following described property as set forth in said Final Judgment, to wit:
A STRIP OF LAND LYING IN A PORTION OF LOT 1, BLOCK 4, SECTION 3 BEE RIDGE FARMS AS RECORDED IN PLAT BOOK A, PAGE 40 OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA AND DESCRIBED AS FOLLOWS:
COMMENCE AT THE INTERSECTION OF THE WEST RIGHT-OF-WAY LINE OF MCINTOSH ROAD (86-FOOT WIDE PUBLIC RIGHT-OF-WAY), AS RECORDED IN OFFICIAL RECORD BOOK 1822, PAGE 2671 AND THE SOUTH RIGHT-OF WAY LINE OF MAGOG ROAD (15-FOOT WIDE PRIVATE RIGHT OF WAY) AS RECORDED IN OFFICIAL RECORD BOOK 2429, PAGES 2793 THROUGH 2812, ALL IN THE ABOVE MENTIONED PUBLIC RECORDS; THENCE S. 00º27'53” W., ALONG SAID WEST RIGHT-OF-WAY LINE, A DISTANCE OF 50.76 FEET TO THE POINT OF CURVATURE OF A CURVE TO THE RIGHT HAVING A RADIUS OF 32.00 FEET AND A CENTRAL ANGLE OF 74º01'16”; THENCE NORTHWESTERLY ALONG THE ARC OF SAID CURVE, AN ARC LENGTH OF 41.34 FEET TO THE END OF SAID CURVE; THENCE N. 89º32'07”W., A DISTANCE OF 31.94 FEET; THENCE N. 00º27'53” E. A DISTANCE OF 20.00 FEET TO A POINT ON THE ABOVE MENTIONED SOUTH RIGHT-OF-WAY LINE OF MAGOG ROAD; THENCE S.89º32'07”E. ALONG SAID SOUTH RIGHT-OF-WAY LINE, A DISTANCE OF 55.13 FEET TO THE POINT OF BEGINNING.
Any person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the Lis Pendens must file a claim within 60 days after the sale.
