NOTICE IS HEREBY GIVEN pursuant to Final Judgment of Foreclosure dated the 12th day of September, 2012, and entered in Case No. 51-2009-CA-005120WS, of the Circuit Court of the 6TH Judicial Circuit in and for Pasco County, Florida, wherein BANK OF AMERICA, NATIONAL ASSOCIATION AS SUCCESSOR BY MERGER TO LASALLE BANK NATIONAL ASSOCIATION (“ASSIGNEE”), FORMERLY KNOWN AS LASALLE NATIONAL BANK, IN ITS CAPACITY AS INDENTURE TRUSTEE UNDER THAT CERTAIN SALE AND SERVICING AGREEMENT DATED JUNE 1, 1999 AMONG AFC TRUST SERIES 1999-2, AS ISSUER, SUPERIOR BANK FSB, AS SELLER AND SERVICER, AND LASALLE BANK NATIONAL ASSOCIATION, AS INDENTURE TRUSTEE, AFC MORTGAGE LOAN ASSET BACKED NOTES, SERIES 1999-2 AND ANY AMENDMENTS THERETO is the Plaintiff and EVETTE OWENS A/K/A EVETTE A MENGEL; ROBERT B MENGEL; UNKNOWN SPOUSE OF EVETTE OWENS N/K/A ROBERT OWNES; UNKNOWN TENANT (S); IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash, on the 11th day of December, 2012, at 11:00 AM on Pasco County's Public Auction website: www.pasco.realforeclose.com, pursuant to judgment or order of the Court, in accordance with Chapter 45, Florida Statutes, the following described property as set forth in said Final Judgment, to wit:
A PORTION OF THE SOUTHEAST 1/4 OF SECTION 29, TOWNSHIP 24 SOUTH, RANGE 17 EAST, PASCO COUNTY, FLORIDA, MORE PARTICULARLY DESCRIBED AS FOLLOWS;
COMMENCE AT THE SOUTHWEST CORNER OF THE SOUTHEAST 1/4 OF SAID SECTION 29; THENCE RUN NORTH 89 DEGREES 51' 10” EAST, 817.00 FEET ALONG THE SOUTH BOUNDARY LINE OF THE SOUTHEAST 1/4 OF SAID SECTION 29; THENCE NORTH 00 DEGREES 03' 27” WEST, 1332.00 FEET TO THE POINT OF BEGINNING; THENCE CONTINEU NORTH 00 DEGREES 03' 27” WEST, 150.00 FEET; THENCE NORTH 89 DEGREES 51' 10” EAST, 296.17 FEET; THENCE SOUTH 00 DEGREES 03' 27” EAST, 150.00 FEET; THENCE SOUTH 89 DEGREES 51' 10” WEST, 296.17 FEET TO THE POINT OF BEGINNING.
SUBJECT TO THE WEST 15 FEET RESERVED AS AN INGRESS/EGRESS EASEMENT.
TOGETHER WITH A MOBILE HOME, PERMANENTLY AFFIXED AND SITUATED THERETO, UPON THE REAL PROPERTY DESCRIBED ABOVE.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
