NOTICE IS HEREBY GIVEN pursuant to to Final Judgment of Foreclosure dated the 18th day of September 2012 and entered in Case No. 2009 CA 009167 NC, of the Circuit Court of the 12TH Judicial Circuit in and for Sarasota County, Florida, wherein THE BANK OF NEW YORK MELLON FORMERLY KNOWN AS THE BANK OF NEW YORK AS SUCCESSOR TRUSTEE TO JPMORGAN CHASE BANK, N.A., AS TRUSTEE FOR THE CERTIFICATEHOLDERS OF STRUCTURED ASSET MORTGAGE INVESTMENTS II TRUST 2006-AR1 MORTGAGE PASS-THROUGH CERTIFICATES, SERIES 2006-AR1 is the Plaintiff and JAROSLAV HORNACEK, FIRST HORIZON HOME LOAN CORPORATION, KIRSTEN PEDERSON and UNKNOWN TENANT(S) IN POSSESSION OF THE SUBJECT PROPERTY are defendants. The Clerk of this Court shall sell to the highest and best bidder for cash electronically at www.sarasota.realforeclose.com at, 9:00 AM on the 25th day of October 2012, the following described property as set forth in said Final Judgment, to wit:
LOT 8, BLOCK B, SPRINGHILL PARK, ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 5, PAGE 30, OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA. LESS; COMMENCE AT THE NORTHEAST CORNER OF SAID LOT 8, THENCE WEST ALONG NORTH LOT LINE 165 FEET, MORE OR LESS, TO THE NORTHWEST CORNER OF SAID LOT; THENCE SOUTH ALONG EASTERLY LINE OF SECOND STREET 75 FEET; THENCE EAST AND PARALLEL TO THE NORTH LOT LINE, A DISTANCE OF 165 FEET, MORE OR LESS, TO THE EASTERLY LOT LINE; THENCE NORTH TO POINT OF BEGINNING. ALSO LESS; BEGIN AT THE NORTHEAST CORNER OF LOT 7, BLOCK B, SPRINGHILL PARK, AS RECORDED IN PLAT BOOK 5, PAGE 30, OF THE PUBLIC RECORDS OF SARASOTA COUNTY, FLORIDA, THENCE NORTHWESTERLY ALONG NORTHERLY BOUNDARY OF SAID LOT 7, 206.57 FEET TO THE MOST NORTHERLY CORNER OF SAID LOT 7; THENCE NORTHEASTERLY ALONG THE WESTERLY BOUNDARY OF LOT 8, BLOCK B, SPRINGHILL PARK SUBDIVISION, 7.3 FEET; THENCE SOUTHEASTERLY 206.75 FEET TO THE POINT OF BEGINNING.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
