NOTICE IS HEREBY GIVEN pursuant to an Order to Reset Foreclosure Sale filed October 2, 2012, and a Final Summary Judgment filed October 1, 2010 entered in Civil Case No.: 36-2009-CA-062457 of the Circuit Court of the TWENTIETH Judicial Circuit in and for LEE COUNTY, Florida, wherein BAC HOME LOANS SERVICING, L.P. F/K/A COUNTRYWIDE HOME LOANS SERVICING, L.P., is Plaintiff, and DANIELLE BEUERLEIN SHICKS F/K/A DANIELLE BEUERLEIN; JOSHUA SHICKS; ANY AND ALL UNKNOWN PARTIES CLAIMING BY, THROUGH, UNDER, AND AGAINST THE HEREIN NAMED INDIVIDUAL DEFENDANT(S), WHO ARE NOT KNOWN TO BE DEAD OR ALIVE, WHETHER SAID UNKNOWN PARTIES MAY CLAIM AN INTEREST AS SPOUSES, HEIRS, DEVISEES, GRANTEES OR OTHER CLAIMANTS; PINEWOODS PROPERTY OWNERS' ASSOCIATION, INC. A/K/A PINEWOODS PROPERTY ASSOCIATION; JOHN DOE AND JANE DOE AS UNKNOWN TENANTS IN POSSESSION, are Defendants.
CHARLIE GREEN, the Clerk of Court shall sell to the highest bidder for cash online at www.lee.realforeclose.com at 9:00 a.m. on the 1st day of November, 2012 the following described real property as set forth in said Final Summary Judgment, to wit:

A TRACT OR PARCEL OF LAND SITUATED IN THE STATE OF FLORIDA, COUNTY OF LEE, BEING PART OF LOTS 55, 56, 57, AND 58, LOCHMOOR, UNIT 2 SUBDIVISION ACCORDING TO THE PLAT OR MAP THEREOF AS RECORDED IN PLAT BOOK 28 AT PAGE 116, OF THE PUBLIC RECORDS OF SAID LEE COUNTY, FLORIDA, SAID PARCEL BOUNDED AND DESCRIBED AS FOLLOWS: STARTING AT THE NORTHEASTERLY MOST CORNER OR SAID LOTS A DISTANCE OF 49.00 FEET, THENCE SOUTH 3 DEGREES 00'00” EAST A DISTANCE OF 18.17 FEET; THENCE SOUTH 87 DEGREES 00'00” WEST A DISTANCE OF 86.00 FEET; A PORTION OF SAID LINE BEING ALONG THE CENTERLINE OF AN EIGHT INCH (8”) WALL SEPARATING RESIDENCE #3 AND RESIDENCE #4; THENCE NORTH 3 DEGREES 00'00” WEST ALONG THE WEST LINE OF SAID LOTS A DISTANCE OF 18.17 FEET; THENCE NORTH 87 DEGREES 00'00” EAST A DISTANCE OF 86.00 FEET, A PORTION OF SAID LINE BEING ALONG THE CENTERLINE OF AN EIGHT INCH (8”) WALL SEPARATING RESIDENCE #3 AND #2 TO THE POINT OF BEGINNING.

If you are a person claiming a right to funds remaining after the sale, you must file a claim with the clerk no later than 60 days after the sale. If you fail to file a claim you will not be entitled to any remaining funds. After 60 days, only the owner of record as of the date of the lis pendens may claim the surplus.
