NOTICE IS HEREBY GIVEN pursuant to an Order Rescheduling Foreclosure Sale filed September 10, 2012, and entered in Case No. 36-2011-CA-054495, of the Circuit Court of the 20th Judicial Circuit in and for LEE County, Florida. THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK AS TRUSTEE FOR THE CERTIFICATEHOLDERS OF THE CWABS, INC., ASSET-BACKED CERTIFICATES, SERIES 2005-12 is Plaintiff and NEVZAT HUSSIEN; CHRISTIANNE HUSSIEN; UNKNOWN PERSON(S) IN POSSESSION OF THE SUBJECT PROPERTY; MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS NOMINEE FOR ACCREDITED HOME LENDERS, INC.; RIVERWALK COVE CONDOMINIUM ASSOCIATION, INC.; UNITED STATES OF AMERICA-DEPARTMENT OF TREASURY; are defendants. I will sell to the highest and best bidder for cash on the 25th day of October, 2012, at www.lee.realforeclose.com, the Clerk's website for online auctions at 9:00 a.m., the following described property as set forth in said Final Judgment, to wit:
UNIT 235, OF HARBOR CAY, A CONDOMINIUM, ACCORDING TO THE CONDOMINIUM DECLARATION THEREOF ON FILE AND RECORDED IN THE OFFICE OF THE CLERK OF THE CIRCUIT COURT OF LEE COUNTY, FLORIDA, IN OFFICIAL RECORDS BOOK 956, PAGES 63 TO 117, AND AS AMENDED AND RESTATED IN OFFICIAL RECORDS BOOK 3060, PAGE 3002; AND ACCORDING TO THE PLAT THEREOF, RECORDED IN CONDOMINIUM PLAT BOOK 3, AT PAGES 137 TO 140, OF THE PUBLIC RECORDS OF LEE COUNTY, FLORIDA, TOGETHER WITH AN UNDIVIDED SHARE OR INTEREST IN THE COMMON ELEMENTS APPURTENANT THERETO IN ACCORDANCE WITH THE DECLARATION OF CONDOMINIUM.
A person claiming an interest in the surplus from the sale, if any, other than the property owner as of the date of the lis pendens must file a claim within 60 days after the sale.
