NOTICE IS HEREBY GIVEN that pursuant to a Uniform Final Judgment of Mortgage Foreclosure dated the 11th day of September, 2012 and entered in Civil Action Number: 2011-CA-3103 in the Circuit Court of the Twelfth Judicial Circuit, in and for Manatee County, Florida, wherein BANK OF THE OZARKS, as Successor in Interest and Assignee of FDIC, as Receiver for HORIZON BANK is the Plaintiff, and SHARP PALMETTO LAND PARTNERSHIP, LLP, SUNCOAST BEEF AND PROVISIONS f/k/a SHARP BEEF AND PROVISIONS, LLC, STEVEN J. SHARP and KATHLEEN M. SHARP, their unknown spouses, heirs, devisees, grantees, creditors and all parties claiming interest by, through, under or against a defendant named in this action, and all persons having or claiming to have any right, title or interest in the property herein described, and all known or unknown sub-contractors, sub-sub-contractors, and materialmen who may claim a right to file a claim of lien, are the Defendants, I, R.B. “CHIPS” SHORE, Clerk of the above-entitled Court, will sell to the highest and best bidder, or bidders, for cash, on the 2nd day of October, 2012, at 11:00 a.m., except as set forth herein, at www.manatee.realforeclose.com, the real and personal property described as follows as set forth in said Uniform Final Judgment of Mortgage Foreclosure situate in Manatee County, Florida:
Complaint Counts: I, II, III, IV: Loan No.: 151592-11
Lots 1, 2, 3, 12, 13, 14, 15, 16, and that portion of Lots 4 and 5, lying South of Railroad all in Block B, EAST PALMETTO, as per Plat thereof recorded in Plat Book 1, Page 161, Public Records of Manatee County, Florida.
LESS and except that portion thereof lying Northwesterly of a line concentric with the Southeasterly as measured radially from the center line of said main tract;
ALSO LESS and except the West 5.8 feet of said Lots 5 and 12;
ALSO LESS and except any portion thereof used or taken for the road right-of-way.
And upon all personal property thereon.
ANY PERSON CLAIMING AN INTEREST IN THE SURPLUS FROM THE SALE, IF ANY, OTHER THAN THE PROPERTY OWNER AS OF THE DATE OF THE LIS PENDENS, MUST FILE A CLAIM WITHIN 60 DAYS AFTER THE SALE.
